Abstract

Akibat hukum dapat timbul oleh karena peristiwa hukum yang terjadi dari segala perbuatan hukum, yaitu perbuatan yang dilakukan oleh subjek hukum terhadap objek hukum atau akibat-akibat lain yang disebabkan karena kejadian-kejadian tertentu oleh hukum yang bersangkutan. Perjanjian jual beli merupakan sebuah perbuatan hukum yang dapat menimbulkan akibat hukum, namun seiring dengan perkembangan hukum, perjanjian jual beli yang dilakukan oleh para pihak dapat menjadi batal demi hukum dengan alasan tidak adanya bukti konversi atas sebidang tanah bekas eigendom melalui putusan di pengadilan oleh Majelis Hakim. Penelitian ini dilakukan dengan pendekatan kasus dan perundang-undangan, dimana melalui penelitian ini dapat disimpulkan apabila tidak ditemukan suatu bukti bahwa tanah eigendom tersebut telah dikonversi sebagai unsur kelengkapan alat bukti di Pengadilan, maka Majelis Hakim berwenang untuk menjatuhkan putusan bahwa pihak yang bersangkutan hanya dapat mengajukan atau memohon haknya atas tanah tersebut. Batas waktu yang diberikan untuk melakukan kegiatan konversi tanah selambat-lambatnya adalah 20 tahun yang dilakukan sejak tanggal 24 September 1960 hingga tanggal 24 September 1980. Berdasarkan ketentuan tersebut, masyarakat harus melakukan pendaftaran ulang atas hak-hak tanah barat yang dimilikinya itu agar segera diterbitkan hak baru atas tanah tersebut. Setelah melewati batas masa waktu yang telah ditentukan, setiap tanah dengan hak-hak barat yang tidak dikonversi secara serentak berubah menjadi tanah yang dikuasai oleh negara, dan seseorang yang ingin memiliki tanah negara tersebut akan diberikan hak prioritas untuk memohon haknya atas tanah itu berdasarkan ketentuan dan peraturan-peraturan hukum yang berlaku. / Legal consequences can arise due to legal events that occur from all legal acts, namely actions carried out by legal subjects against legal objects or other consequences caused by certain events by the law in question. A sale and purchase agreement is a legal act that can give rise to legal consequences, however, along with legal developments, the sale and purchase agreement entered into by the parties can become null and void on the grounds that there is no proof of conversion of a plot of former eigendom land through a decision in court by the Judges. This research was carried out through a case and statutory approach, where through this research it can be concluded that if no evidence is found that the eigendom land has been converted as an element of complete evidence in court, then the Judges has the authority to make a decision that the party concerned can only submit or request their rights to the land. The time limit given to carry out land conversion activities is no later than 20 years, which was carried out from 24th September 1960 to 24th September 1980. Based on these provisions, the community must re-register the western land rights they own so that the rights can be immediately issued new to the land. After the specified time limit has passed, any land with western rights that has not been converted since the conversion limit has passed will simultaneously become state land, and someone who wants to own the land will be given priority rights to apply for their rights to that land based on the provisions and applicable legal regulations.
