Abstract

Perkembangan pasca covid-19 banyak transaksi yang menggunakan transaksi secara non tunai/cashless. Perkembangan tersebut dapat dilihat dari meningkatnya nilai total transaksi sebesar Rp 786,35 Triliun pada 2021. Uang Elektronik disimpan secara elektronik dalam suatu media server based atau chip based dan pencatatan data identitas dapat berupa unregistered atau registered. Simpanan pada uang elektronik dijamin oleh Lembaga Penjamin Simpanan. Penelitian ini bersifat normatif, untuk data yang digunakan merupakan data sekunder sedangkan dalam pengumpulan data menggunakan studi kepustakaan. Pendekatan dilakukan dengan sistematika hukum dan menggunakan metode analisis data kualitatif. Hasil penelitian menunjukan bahwa secara peraturan perundang-undangan uang elektronik tidak dapat dilakukannya penjaminan oleh Lembaga Penjamin Simpanan karena hanya definis dari uang elektronik tersebut hanya sebagai instrumen pembayaran. Pihak Bank sebagai salah satu penerbit hanya memberikan perlindungan hukum yang terbatas bagi pemilik saldo uang elektronik/Post-covid-19 developments, many transactions use non-cash/cashless transactions. This development can be seen from the increase in the total transaction value of IDR 786.35 trillion in 2021. Electronic money is stored electronically in a server based or chip based medium and the recording of identity data can be unregistered or registered. Savings in electronic money are guaranteed by the Deposit Insurance Corporation. This research is normative in nature, the data used is secondary data, while data collection uses library research. The approach is carried out with legal systematics and uses qualitative data analysis methods. The results of the research show that according to electronic money regulations, guarantees cannot be provided by the Deposit Insurance Corporation because the definition of electronic money is only as a payment instrument. Banks as one of the issuers only provide limited legal protection for owners of electronic money balances.
