Abstract

Penelitian ini membahas dinamika gugatan yang diajukan oleh Uni Eropa terhadap Indonesia mengenai kebijakan larangan ekspor bijih nikel. Indonesia merupakan produsen terbesar nikel kedua di Dunia. Pemerintah Indonesia menerapkan aturan ini sebagai bagian dari upaya untuk mengatur pemanfaatan sumber daya alam dan peningkatan nilai tambah industri dalam negeri. Uni Eropa, sebagai mitra dagang utama Indonesia, menggugat kebijakan ini melalui jalur hukum internasional, merinci dampak-dampak ekonomi, lingkungan, dan sosial yang mereka klaim timbul akibat kebijakan tersebut. Penelitian ini mengemukakan kepentingan Indonesia dalam melarang ekspor bahan mentah dan memilih untuk mengolahnya terlebih dulu di dalam negeri. Selain itu, penelitian ini juga memperoleh identifikasi faktor-faktor politik, ekonomi, dan lingkungan yang menjadi latar belakang dari kebijakan larangan ekspor bijih nikel, serta mempertimbangkan implikasi jangka panjang dari perselisihan ini terhadap hubungan dagang bilateral antara Indonesia dan Uni Eropa. Metode penelitian yang digunakan yakni pendekatan deskriptif kualitatif. Pemerolehan data didapat menggunakan data yang berasal dari studi pustaka. Data sekunder yang dimaksud adalah data yang sudah pernah diteliti dan sudah ada. Hasil penelitian ini diharapkan dapat meningkatkan pemahaman yang lebih komprehensif terkait dengan kompleksitas isu ini, memberikan wawasan terhadap aspek-aspek hukum dan diplomasi yang terlibat, serta merinci potensi solusi atau kompromi yang dapat ditempuh untuk menyelesaikan konflik ini. Penelitian ini diharapkan bisa berperan dalam pengembangan literatur terkait hukum perdagangan internasional, kebijakan lingkungan, serta dinamika hubungan antar negara dalam konteks globalisasi ekonomi. / This research discusses the dynamics of the lawsuit filed by the European Union against Indonesia regarding the policy of banning nickel ore exports. Indonesia is the world's second-largest producer of nickel. The Indonesian government implemented this regulation as part of an effort to regulate the use of natural resources and increase the value-added of domestic industries. The European Union, as Indonesia's main trading partner, contested this policy through international legal channels, detailing the economic, environmental, and social impacts they claim arise from this policy. The research puts forward Indonesia's interest in prohibiting the export of raw materials and choosing to process them domestically first. Additionally, the study identifies the political, economic, and environmental factors that underlie the policy of banning nickel ore exports, considering the long-term implications of this dispute on the bilateral trade relations between Indonesia and the European Union. The research methodology used is a qualitative descriptive approach. Data acquisition was obtained using data from literature studies. The mentioned secondary data refers to data that has been previously researched and already exists. The results of this research are expected to enhance a more comprehensive understanding of the complexity of this issue, provide insights into the legal and diplomatic aspects involved, and detail potential solutions or compromises that can be pursued to resolve this conflict. This study is expected to play a role in the development of literature related to international trade law, environmental policy, and the dynamics of inter-country relations in the context of economic globalization.
