Abstract

Pada tahun 2001, Indonesia bergulat dengan status daftar hitam Financial Action Task Force (FATF) dikarenakan kurangnya regulasi dan kerjasama internasional terkait kejahatan finansial pencucian uang dan pendanaan terorisme. Berbagai upaya seperti reformasi birokrasi dan regulasi telah dilakukan untuk memenuhi syarat yang telah dimandatkan oleh FATF, dan puncak dari upaya ini adalah diperolehnya status Indonesia sebagai anggota ke-40 FATF pada Oktober 2023. Dengan menggunakan perspektif neoliberalisme, paradigma penelitian kualitatif, metode studi kasus, dan triangulasi sebagai metode pengumpulan data, tesis ini menginvestigasi peran FATF dalam tata kelola global kejahatan finansial serta keputusan strategis Indonesia untuk menjadi anggota tetap dalam satuan tugas tersebut. Hasil penelitian menunjukkan bahwa meskipun FATF beroperasi dalam ranah 'hukum lunak,' kepatuhan terhadap rekomendasinya sangat penting bagi negara-negara yang mencari keamanan finansial. Gugus tugas ini mampu mengubah norma-norma hukum lunak tersebut menjadi mandat hukum yang keras, yang kemudian berfungsi sebagai alat penting untuk melawan pencucian uang dan pendanaan terorisme secara global. Upaya Indonesia untuk mencapai keanggotaan permanen FATF didorong oleh keinginan untuk meningkatkan posisinya agar sejajar dengan negara maju dan memengaruhi proses pembuatan kebijakan global. Belajar dari pengalaman Singapura dan Malaysia, tesis ini menyoroti potensi keanggotaan FATF untuk meningkatkan pengaruh politik dan kredibilitas keuangan Indonesia di kancah global. Konsisten dengan pendekatan neoliberalisme dalam hubungan internasional, keputusan ini pada akhirnya mencerminkan keputusan Indonesia sebagai kalkulasi rasional, dimana Indonesia mengakui nilai dan manfaat dari partisipasi dalam organisasi internasional sebagai wadah untuk memajukan kepentingan nasionalnya dan komitmen terhadap komunitas internasional. / In 2001, Indonesia was included in the Financial Action Task Force (FATF) blacklist status due to a lack of regulation and international cooperation regarding the financial crimes of money laundering and terrorist financing. Since then, various efforts such as bureaucratic and regulatory reform have been carried out to fulfill the requirements mandated by the FATF. The culmination of these efforts resulted in the attainment of Indonesia’s status as the 40th member of FATF in October 2023. Employing neoliberalism perspective, qualitative research paradigm, case study, and triangulation as research and data collection methods, this thesis investigates the role of FATF in global governance against financial crimes and delves into Indonesia's strategic decision to assume a permanent role within this task force. Findings indicate that, despite the FATF’s operation of ‘soft law,’ adherence to its recommendations is crucial for nations seeking financial security, as the task force can transform these into hard law mandates, serving as pivotal tool against global money laundering and terrorism financing. Furthermore, Indonesia’s well-considered and diligently executed endeavor for permanent FATF membership is driven by a desire to elevate its standing on par with developed nations and influence global policy-making processes. Drawing insights from the experiences of Singapore and Malaysia, this thesis highlights the potential of FATF membership to increase Indonesia's political influence and financial credibility on the global stage. Consistent with a neoliberal approach to international relations, Indonesia’s decision ultimately reflects a calculated effort as a rational actor by recognizing the value of participating in a global institution as a platform to promote national interest and commitment to the international community.
