Abstract

Beberapa tahun terakhir, pemanfaatan teknologi pembayaran digital menjadi semakin populer di Indonesia dengan hadirnya OVO, Gopay, DANA, Shopeepay, sebagai produk fintech yang telah digunakan secara luas dalam bentuk dompet digital. BI juga telah menerbitkan blueprint Sistem Pembayaran Indonesia (SPI) 2025, dimana salah satu targetnya adalah membawa 91.3 juta populasi penduduk unbanked dan 62.9 juta UMKM ke dalam ekonomi dan keuangan formal secara berkelanjutan melalui pemanfaatan digitalisasi di sektor finansial dan sektor riil. Teknologi Informasi saat ini menjadi pedang bermata dua karena selain memberikan kontribusi bagi peningkatan kesejahteraan, kemajuan, dan peradaban manusia, sekaligus menjadi sarana efektif perbuatan melawan hukum. Ada banyak kejahatan mayantara (cyber crime) yang mengintip para pengguna dompet digital. Penelitian ini membahas perkembangan peraturan perlindungan konsumen terkait transaksi dompet digital di Indonesia dan efektivitas penerapan peraturannya terhadap kasus cybercrime dalam transaksi dompet digital. Kehadiran UU Pelindungan Konsumen Nomor 8 Tahun 1999, UU Informasi dan Transaksi Elektronik No 8 Tahun 2011, dan terakhir Undang-Undang Perlindungan Data Pribadi No 27 Tahun 2022, merupakan perwujudan perlindungan negara untuk memastikan pemenuhan hak akan kepastian dan keadilan hukum bagi warga negaranya. / In recent years, using digital payment technology has become increasingly popular in Indonesia with the presence of OVO, Gopay, DANA, Shopeepay, as fintech products that have been widely used as digital wallets. BI has also published a blueprint for the Indonesia Payment System (SPI) 2025, where the target is to bring the 91.3 million unbanked population and 62.9 million MSMEs into the formal economy and finance in a sustainable manner using digitalization in the financial and real sectors. Information technology is a double-edged sword because not only improving human welfare, progress, and civilization, it is also an effective means of committing unlawful acts. There are many cybercrimes that spy on digital wallet users. This research discusses the development of consumer protection regulations related to digital wallet transactions in Indonesia and the effectiveness of implementing these regulations in cybercrime cases in digital wallet transactions. The presence of the Consumer Protection Law No 8 of 1999, the Information and Electronic Transactions Law No 8 of 2011, and lastly the Personal Data Protection Law No 27 of 2022, is a manifestation of state protection to ensure the fulfillment of the rights to legal certainty and justice for its citizens.
