Abstract

Suku bunga floating di dalam Kredit Pemilikan Rumah sebagai sarana tata kelola risiko bank mengakibatkan beban debitur menjadi tidak pasti apalagi ketika debitur tidak memiliki posisi tawar dalam menentukan tingkat suku bunga. Penelitian ini menggunakan pendekatan kualitatif yaitu melalui analisa hukum normatif empiris. Analisis hukum normatif empiris terdiri dari analisa hukum secara normatif dan analisa hukum secara empiris. Pendekatan empiris digunakan untuk mendukung pendekatan normatif dengan melihat bagaimana praktek penentuan tingkat suku bunga kredit pemilikan rumah oleh bank dan membandingkannya dengan peraturan yang seharusnya. Bank Indonesia menetapkan Suku Bunga Dasar Kredit yang dijadikan acuan bagi bank komersial. Bank Indonesia mewajibkan agar Suku Bunga Dasar Kredit ini dilaporkan agar terjadi transparansi tingkat suku bunga sehingga bank komersial lain dapat melihatnya dan terjadi kompetisi pemberian tingkat bunga. Bagi konsumen pelaporan dan transparansi bertujuan untuk memberikan pilihan bagi konsumen sebelum meminjam. Pada praktiknya di lapangan bank umumnya tidak memberikan pilihan suku bunga fixed. Jikalau terdapat suku bunga fixed maka suku bunga fixed diberikan dalam waktu yang relatif singkat dibandingkan dengan total waktu pinjaman. Debitur mengerti bahwa bank perlu mengelola risiko dengan menggunakan bunga floating. Namun demikian debitur tetap merasa di beratkan oleh keberadaan bunga floating. Saat ini tidak ada pengaturan secara mendetail terkait seberapa besar penyesuaian dan tata cara penyesuaian sehingga debitur rawan untuk dirugikan. Oleh karena itu diperlukan pengaturan lebih mendetail dari pemerintah terkait pengaturan penyesuaian tingkat suku bunga floating. Di dalamnya perlu dimasukkan pengaturan terkait suku bunga maksimal yang dapat diberikan oleh bank secara khusus pada kredit kepemilikan rumah. / Floating interest rates in Home Ownership Loans as a means of bank risk governance result in the debtor's burden becoming uncertain, especially when the debtor has no bargaining position in determining the interest rate. This research uses a qualitative approach, namely through empirical normative legal analysis. Empirical normative legal analysis consists of normative legal analysis and empirical legal analysis. The empirical approach is used to support the normative approach by looking at how the practice of determining the interest rate of mortgage loans by banks and comparing it with the regulations that should be. Bank Indonesia sets the Prime Lending Rate which is used as a reference for commercial banks. Bank Indonesia requires that the Prime Lending Rate be reported in order to ensure transparency of interest rates so that other commercial banks can see it and there is competition in providing interest rates. For consumers, reporting and transparency aims to provide choice for consumers before borrowing. In practice, banks generally do not provide fixed interest rate options. If there is a fixed interest rate, the fixed interest rate is given for a relatively short period of time compared to the total loan period. Debtors understand that banks need to manage risk by using floating interest rates. However, debtors still feel burdened by the existence of floating interest rates. Currently, there is no detailed regulation regarding the amount of adjustment and the procedure for adjustment so that debtors are prone to being disadvantaged. Therefore, more detailed arrangements are needed from the government regarding the regulation of floating interest rate adjustments. It is necessary to include regulations related to the maximum interest rate that can be given by banks specifically on home ownership loans.
