Abstract

The entertainment industry comprises labors ranging from various ages, child actors being amongst them. In this line of work, protection of child actors should be held at the highest priority, meaning it should be ensured by government-issued laws in every country. Child actors as minors deserve their children’s human rights to be fulfilled, especially the right for the appeasement of their best interests and the right to be protected from any harm. The legal system in Indonesia has yet to establish a specific law to fulfill child protection in the entertainment industry. In contrast, the State of California in the United States of America has administered a set of regulations which ensures child labor protection in the entertainment industry. Such regulations are issued through the California Code of Regulations, with provisions designed solely to cater to the particular working conditions and the children’s need for balance of life even while working as an actor. Regarding this fact, the author has referenced the United States of America as the country used in this thesis’ comparative law analysis against Indonesia. In conducting this research, the author uses normative legal research methods. Based on extensive examination on the matter, the author decides that America’s laws are significantly more comprehensive as opposed to Indonesia’s in safeguarding the welfare of child actors. Apart from the government, the United States is equipped with labor enforcement divisions and labor unions set to uphold actors’ rights nationwide. This reveals how much Indonesia is lacking in terms of child protection as a whole, and indicates the presence of legal vacuum for child actor protection as well. It is expected from these revelations that the Indonesian government shall provide adequate safety measures for child labors in the entertainment industry in the form of regulation enforcement and socialization efforts, just as the United States does.
