Abstract

Tujuan penelitian ini adalah untuk menganalisis latar belakang penerapan Qanun Jinayah terhadap perempuan yang tidak menggunakan jilbab berdasarkan prinsip keadilan bermartabat. Penelitian ini menggunakan metode yuridis normatif dengan penalaran deduktif. Hasil penelitian menunjukkan bahwa penerapan Qanun Jinayah terhadap perempuan tidak menggunakan jilbab, sebagaimana diatur qanun Aceh Nomor 11 tahun 2002, mencerminkan kompleksitas dinamika sosial, politik, dan agama, dengan tujuan menjaga identitas Islam yang konservatif. Meskipun diakui sebagai upaya untuk mendisplinkan perempuan dalam ruang publik, dan kebebasan berekspresi, memunculkan diskusi tentang sejauh mana prinsip keadilan bermartabat dan penghormatan terhadap hak-hak dasar perempuan tercemin dalam aturan tersebut. Dinamika tersebut perlu diselaraskan dengan perspektif keadilan bermartabat, di mana menjaga nilai-nilai lokal dan melindungi kepercayaan agama harus seimbang dengan menghormati hak-hak asasi individu, agar penerapan aturan dapat mengakomodasi pluralitas nilai dan memastikan tindakan hukuman tidak merugikan martabat perempuan secara tidak adil. Oleh karena itum disarankan untuk memperkuat dialog antara pemerintah dan masyarakat guna mencapai keseimbangan yang lebih baik, serta memastikan bahwa aturan yang diterapkan benar-benar mencerminkan prinsip-prinsip keadilan yang bermartabat dan menghormati hak-hak dasar perempuan. / The purpose of this study is to analyze the background of the application of Qanun Jinayah against women who do not use a rod based on the principle of fairness and dignity. This study uses normative jurdicial methods with deductive reasoning. The results of the research show that the application of the Jinayah Qur'an to women without the use of scissors, as regulated by the Aceh Qu'an No. 11 of 2002, reflects the complexity of social, political, and religius dynamics, with the aim of preserving a conservative Islamic identity. Although recognized as an attempt to discipline women in public spaces, the implementation of the rule raises internal tensions regarding individual rights and freedom of expression, raising a debate on the extent to which the principle of justice with dignity and respect for women's fundamental rights are reflected in the rules. Such dynamics need to be aligned with the perspective of decent justice, where perserving local values and protecting religous beliefs must be balanced with respect for individual rights, so that the application of the rules can accommodate pluralism of values, and ensure that punishment does not unfairly harm the dignity of women. It is therefore recommended to strengthen dialogue between government and public in order to a better balance, as well as to ensure that the rules applied genuinely reflect the principles of decent justice and respect for women's fundamental rights.`
