Abstract
The concept of compensation in the acquisition of land for development in the public interest as mandated by Law Number 2 Year 2012 is proper and just compensation for victims of land acquisition, both for land affected by land acquisition and residual or remaining land not affected by the land acquisition by taking into the account principles of land acquisition. Komang Ani Susana as Petitioner of Objection (Plaintiff), in this case, filed a request for compensation of her remaining-land-owned to the Land Procurement Agency (Institute Land Acquisition) for the construction of the Kunciran-Serpong Toll Road Project. The request was rejected and subsequently, the Petitioner (Plaintiff) filed an objection to the Tangerang District Court as in court verdict No. 333/Pdt.G/2018/PN Tng. The Panel of Judges rejected the petition of objection; therefore, a legal appeal to the Supreme Court was again submitted by the Petitioner (Plaintiff) which resulted in the strengthening of Tangerang District Court's decision by the Supreme Court Judge Panel. This resulted in the Petitioner (Plaintiff) losing at the trial (hearing). The purpose of this study is to analyze the legal settlement and find out the legal considerations and judges' decision on the request for compensation for the residual land using the normative juridical method and the legislation, case and conceptual approach. The result of this study is Law Number 2 Year 2012 and its implementing regulations have provided guarantees and legal protection to victims of land acquisition through the right to claim compensation if s/he feels that the remaining land can still be re-functioned and compensation can be given. In this case, the legal settlement can be taken in a form of an appeal. The Panel of Judges had carefully considered and made the fairest decisions in accordance with the applicable land acquisition rules by rejecting the request for compensation for the remaining land on the grounds that the land could still be used in accordance with its original designation and use.
