Abstract

Keberadaan Tenaga Kerja Asing (TKA) merupakan kenyataan yang tidak dapat dipungkiri, untuk memenuhi kebutuan akan tenaga kerja ahli dan mengusasi teknologi khusus yang belum dapat dipenuhi oleh tenaga kerja Indonesia. Tujuan dari penelitian ini agar mengetahui perlindungan hukum Ketenagakerjaan terhadap TKA dan untuk mengetahui upaya pemerintah Kota Medan dalam melindungi TKA yang bekerja di Kota Medan. Penulisan ini adalah penelitian hukum normatif-empiris, yakni penggabungan pendekatan hukum normatif dengan penambahan unsur empiris. Penelitian ini mengenai implementasi ketentuan hukum-hukum ketenagakerjaan terhadap perlindungan TKA. Penelitian mengutamakan data sekunder berupa bahan hukum primer, sekunder dan tertier, didukung oleh data primer berupa hasil wawancara dengan narasumber dari Disnaker Kota Medan, Kantor Imigrasi Kelas 1 TPI Polonia Medan dan dua orang TKA yang bekerja di Kota Medan. Pendekatan penelitian adalah pendekatan perundang-undangan dan konseptual. Analisis data dilakukan secara kualitatif dengan metode deskriptif-analisis. Sejalan dengan tujuan agar tercapainya tujuan didalam pelaksanaan peningkatan nasional Indonesia baik didalam bentuk dalam meningkatkan pembangunan, perekonomian maupun peningkatan sosial dan teknologi didalam era globalisasi serta meningkat nya pembangunan di segala sektor kehidupan, maka tentunya dibutuhkan kualitas sumber daya manusia yang handal serta ahli di bidangnya seperti Tenaga Kerja Asing. / The existence of Foreign Workers (TKA) is an undeniable reality, to meet the needs of skilled workers and master special technology that has not been able to be fulfilled by Indonesian workers. The purpose of this study is to find out the protection of labor law against foreign workers and to find out the efforts of the Medan City government in protecting foreign workers working in Medan City. The writing of this thesis uses normative-empirical legal research, by combining normative legal approaches, namely the addition of various elements in the form of empirical elements. Normative-empirical legal research on the implementation of normative of labor law on the protection of foreign workers. This study prioritizes secondary data in the form of primary, secondary and tertiary legal materials, which are supported by primary data in the form of interviews with resource persons from the Medan City Manpower Office, Immigration Office Class 1 TPI Polonia Medan and two foreign workers working in Medan City. The research approach is a statutory and conceptual approach. Data analysis is carried out qualitatively by descriptive-analysis method. In line with the aim of achieving goals in the implementation of Indonesia's national improvement both in the form of improving development, economy and social and technological improvements in the era of globalization and increasing development in all sectors of life, it certainly takes the quality of reliable human resources and experts in their fields such as Foreign Workers.
