Abstract

Tujuan dari penelitian skripsi terhadap kasus Hak Merek Waffelicious oleh Budhy Cipta Kurniawan Hendra Wijaya vs Adi Bagus Kristanto (Studi Putusan Nomor 5/Pdt.Sus-HKI.Merek/2020/PN Smg) untuk mendapatkan informasi dan pengetahuan mengenai: (1) untuk mendeskripsikan upaya perlindungan hukum pendaftaran produk waffelicious dalam putusan pengadilan. (2) untuk mendeskripsikan pertimbangan hukum hakim dalam putusan pengadilan tentang pembatalan atau penghapusan merek. Penelitian skripsi ini menggunakan jenis penelitian hukum normatif. (peraturan perundang-undang, buku-buku, dan sumber-sumber kepustakaan lainnya). Jenis data yang digunakan adalah sekunder yang terbagi atas bahan hukum primer, bahan hukum sekunder dan bahan hukum tersier. Metode perolehan data dilakukan dengan cara mengumpulkan bahan hukum dan peraturan perundang-undangan menggunakan metode studi kepustakaan. Analisis data dari hasil penelitian ini menggunakan metode penelitian hukum normatif, yaitu penelitian ilmiah untuk menempatkan kebenaran berdasarkan logika keilmuan dari sisi normatif. Hasil penelitian dari penelitian skripsi ini adalah Upaya Perlindungan Pendaftaran Produk Waffelicious dalam Pengadilan Nomor 5/Pdt.Sus-HKI.Merek/2020/PN.Smg dan Pertimbangan Hukum Hakim dalam dalam Pengadilan Nomor 5/Pdt.Sus-HKI.Merek/2020/PN.Smg tentang Pembatalan atau Penghapusan Merek, yang membahas permasalahan berupa persamaan merek wafle yang dilakukan tanpa adanya izin dan dilakukannya pendaftaran hak merek dengan itikad yang tidak baik oleh Penggugat yaitu Budhy Cipta yang telah melakukan itikad buruk dalam mendaftarkan merek “Waffelicious” yang merupakan merek yang berawal mula dari Tergugat yaitu Adi Bagus yang mencetuskan ide dan pencipta usaha dalam usaha “Waffelicious” dengan pembagian hasil masing-masing mendapatkan 50% sesuai dengan perjanjian yang telah disepakati oleh kedua belah pihak akan tetapi menggunakan merek Waffelicious tanpa izin yang menyebabkan kerugian terhadap Penggugat dikarenakan yang dijual lebih murah atau dengan harga dibawah harga yang ada pada merek asli dari “Waffelicious itu sendiri, selain itu juga hal ini ditunjukkan oleh adanya kemiripan yang disebabkan oleh adanya unsur yang dominan antara merek yang satu dengan merek yang lain sehingga telah menimbulkan kesan adanya persamaan, baik mengenai bentuk, cara penempatan, cara penulisan atau kombinasi antara unsur, atau kemiripan ataupun persamaan bunyi ucapan yang terdapat dalam merek tersebut. Berdasarkan hasil penelitian dan pembahasan dapat disimpulkan terkabulkan gugatan pembatalan merek “Waffelicious” yang beritikad tidak baik, sudah sesuai dengan ketentuan yang telah diatur dalam Pasal 21 Ayat (3) Undang-Undang Nomor 20 Tahun 2016 Tentang Merek dan Indikasi Geografis. Akibat hukum dari pembatalan merek “Waffelicious” adalah merek tersebut dicoret dari Daftar Umum Merek Direktorat Jenderal Kekayaan Intelektual, sehingga mengakibatkan berakhirnya perlindungan hukum atas merek tersebut./The purpose of the thesis research on the Waffelicious Brand Rights case by Budhy Cipta Kurniawan Hendra Wijaya vs Adi Bagus Kristanto (Decision Study Number 5/Pdt.Sus-HKI.Merek/2020/PN Smg) is to obtain information and find out about: (1) to describe efforts to protect the legal registration of waffelicious products in court decisions. (2) to describe the judge's legal considerations in court decisions regarding cancellation or removal of trademarks. The thesis research uses a type of normative legal research. (legislation, books and other literary sources). The type of data used is secondary which is divided into primary legal materials, secondary legal materials and tertiary legal materials. The data acquisition method was carried out by collecting legal materials and statutory regulations using the literature study method. Analysis of data from the results of this research uses normative legal research methods, namely scientific research to locate the truth based on scientific logic from the normative side. The results of this thesis research are Efforts to Protect the Registration of Waffelicious Products in Court Number 5/Pdt.Sus-HKI.Merek/2020/PN.Smg and the Judge's Legal Considerations in Court Number 5/Pdt.Sus-HKI.Merek/2020/ PN.Smg concerning Cancellation or Removal of Trademarks, which discusses issues in the form of wafle brand similarities carried out without permission and the registration of trademark rights in bad faith by the Plaintiff, namely Budhy Cipta, who has carried out bad faith in registering the "Waffelicious" mark which is The brand originates from the Defendant, namely Adi Bagus, who initiated the idea and created the business in the "Waffelicious" business with a share of the profits, each getting 50% in accordance with the agreement agreed upon by both parties, but using the Waffelicious brand without permission which caused losses to The plaintiff was because it was sold cheaper or at a price below the price of the original brand of "Waffelicious itself, apart from that, this was also shown by the similarity caused by the presence of a dominant element between one brand and another, so that it gave the impression the existence of similarities, whether regarding the shape, method of placement, method of writing or combination of elements, or similarity or similarities in the sound of speech contained in the mark. Based on the results of the research and discussion, it can be concluded that the lawsuit for canceling the "Waffelicious" brand which was in bad faith was granted, in accordance with the provisions stipulated in Article 21 Paragraph (3) of Law Number 20 of 2016 concerning Marks and Geographical Indications. The legal consequence of canceling the "Waffelicious" brand is that the brand is removed from the General Register of Trademarks of the Directorate General of Intellectual Property, resulting in the end of legal protection for the brand.
