Abstract

Repackaging products in share-in-jar is a process of dividing the contents of a product from its original size into several smaller containers. Such products are popular amongst consumers who are looking for product samples to try on before buying the actual product that tends to be costly. However, several business actors are selling share-in-jar products that do not conform with the applicable law, namely by failing to comply with the sanitary and hygiene requirements during the repackaging process and not providing detailed product information, therefore, resulting in consumer losses. The cosmetics industry has seen a proliferation of these practices, which pose various risks to consumers. In light of this, a controversy arose concerning legal protection for consumers who suffer losses as a result of the sale of cosmetics in share-in-jar and the legal liability of business actors for the losses incurred by consumers who use share in jar cosmetics. The objective of this research is to look into the consumer protection policies that develop as a result of violations of the Indonesian Law, as well as the legal culpability of business actors for infringing on consumers' rights while buying and selling cosmetics. This study delves into the existing legal protections, consumer rights, and regulatory gaps within the Indonesian context. It employs a comprehensive analysis of relevant laws, regulations, and case studies to assess the effectiveness of the current legal framework. Furthermore, it investigates the challenges faced by consumers in terms of product safety, quality, and information disclosure. The research aims to provide insights into the necessity of enhancing legal safeguards and consumer education to ensure a safer and more transparent cosmetics market in Indonesia's e-commerce landscape./Pengemasan ulang produk dalam share-in-jar merupakan proses membagi isi produk dari kemasan aslinya ke dalam beberapa wadah yang lebih kecil. Produk semacam ini populer di kalangan konsumen yang mencari sampel produk untuk dicoba sebelum membeli produk sebenarnya yang cenderung mahal. Namun, pada prinsipnya, penjualan produk share-in-jar yang tidak sesuai dengan peraturan perundang-undangan yang berlaku, karena tidak memenuhi persyaratan sanitasi dan higiene pada proses pengemasan ulang serta tidak memberikan informasi produk secara detail sehingga mengakibatkan kerugian bagi konsumen. Sehubungan dengan hal tersebut timbul kontroversi mengenai perlindungan hukum terhadap konsumen yang mengalami kerugian akibat penjualan kosmetika share-in-jar dan tanggung jawab hukum pelaku usaha atas kerugian yang ditimbulkan oleh konsumen pengguna kosmetika share-in-jar. Tujuan penelitian ini adalah untuk kerangka hukum penjualan produk share-in-jar, serta perlindungan konsumen yang membeli produk share-in-jar. Tujuan dari penelitian ini adalah untuk melihat kebijakan perlindungan konsumen yang berkembang akibat pelanggaran Hukum Indonesia, serta kapasitas hukum pelaku usaha saat melanggar hak konsumen dalam jual beli kosmetik. Studi ini menggali perlindungan hukum, hak-hak konsumen, dan kesenjangan peraturan yang ada dalam konteks Indonesia. Pendekatan ini menggunakan analisis komprehensif terhadap undang-undang, peraturan, dan studi kasus yang relevan untuk menilai efektivitas kerangka hukum yang ada saat ini. Selain itu, penelitian ini menyelidiki tantangan yang dihadapi konsumen dalam hal keamanan produk, kualitas, dan keterbukaan informasi. Penelitian ini bertujuan untuk memberikan wawasan mengenai perlunya meningkatkan perlindungan hukum dan pendidikan konsumen untuk memastikan pasar kosmetik yang lebih aman dan transparan di lanskap e-commerce Indonesia.
