Abstract

Penelitian ini membahas mengenai permasalahan “Pengaturan Hukum Terhadap Kasus Euthanasia Non Sukarela (Non Voluntary) Di Indonesia Berdasarkan Peraturan KUHP Ditinjau Menggunakan Teori Keadilan Bermartabat” dimana peneliti menganggap bahwa tindakan euthanasia merupakan suatu tindakan yang cukup kontrovensi. Berdasarkan dengan Pasal 338 KUHP dan Pasal 344 KUHP euthanasia merupakan tindakan yang melanggar hukum. Akan tetapi terdapat tindakan Euthanasia yang di lakukan terhadap Pasien yang mengalami mati batang otak, berdasarkan dengan Pasal 117 UU Kesehatan No. 36 Tahun 2009 mati batang otak sama halnya dengan kematian menurut medis. Karena itu, masih terdapat perdebatan mengenai tindakan euthanasia apakah boleh di lakukan atau tidak, karena di atur dalam Undang-Undang bahwa orang yang telah mengalami mati batang otak harus segera di cabut alat bantu hiduonya, karena orang yang mengalami mati batang otak di kategorikan sebagai salah satu bentuk kematian. Sehingga peneliti melakukan penelitian terhadap kasus ini menggunakan metode penelitian hukum normatif untuk mendapatkan kesimpulan terhadap permasalahan tindakan euthanasia ini. Dimana terdapat tindakan euthanasia yang masih kerap di lakukan di Indonesia, akan tetapi tindakan euthanasia tersebut di lakukan secara pasif. Dimana tidak terdapat obat-obatan yang di suntikkan secara langsung kedalam tubuh pasien. Walaubegitu, tetap terdapat persyaratan yang harus di lakukan sebelum melakukan tindakan euthanasia tersebut dilaksanakan terhadap pasien. Tindakan euthanasia sendiri dapat di lihat dari segi kemoralan dari seseorang, dalam penelitian ini penulis menggunakan teori keadilan bermartabat untuk melihat dan menilai terkait sisi kemanusiaan dari teori keadilan bermartabat. Dimana teori tersebut memiliki pandangan bahwa kita harus dapat memanusiakan manusia dalam kondisi dan situasi apapun, maka apakah tindakan eutanasia merupakan perbuatan yang tidak memanusiakan manusia? / This research discusses the problem of "Legal Arrangements for Non-Voluntary Euthanasia Cases in Indonesia Based on Criminal Code Regulations Reviewed Using the Theory of Dignified Justice" where researchers consider that the act of euthanasia is quite a controversial action. Based on Article 338 of the Criminal Code and Article 344 of the Criminal Code, euthanasia is an unlawful act. However, there is euthanasia carried out on patients who experience brain stem death, based on Article 117 of the Health Law no. 36 of 2009, brain stem death is the same as medical death. Because of this, there is still debate regarding whether euthanasia can be carried out or not, because it is regulated in the law that people who have experienced brain stem death must immediately have their life support removed, because people who have experienced brain stem death are categorized as having a form of death. So researchers conducted research on this case using normative legal research methods to obtain conclusions regarding the problem of euthanasia. There are acts of euthanasia that are still frequently carried out in Indonesia, but these acts of euthanasia are carried out passively. Where there are no drugs that are injected directly into the patient's body. However, there are still requirements that must be met before euthanasia is carried out on a patient. The act of euthanasia itself can be seen from a person's moral perspective. In this research the author uses the theory of dignified justice to see and assess the human side of the theory of dignified justice. Where this theory holds the view that we must be able to humanize humans in any condition and situation, then is the act of euthanasia an act that does not humanize humans?
