Abstract

Penelitian ini meneliti permasalahan upaya preventif yang dilakukan oleh bank BCA mengajukan permohonan kredit dengan melampirkan berkas-berkas yang sudah ditentukan oleh bank, kemudian dilakukan analisis terhadap berkas-berkas tersebut, dan dilakukan survei secara langsung oleh petugas bank, kemudian dilakukan analisis dan evaluasi berkas-berkas, kemudian baru diputuskan apakah kredit tersebut diterima atau ditolak. Adapun upaya hukum yang dapat ditempuh nasabah dalam melakukan penyelesaian hukum akibat terjadinya kerugian yang timbul dari KPR ini yaitu melalui cara litigasi (jalur pengadilan) dan non litigasi (jalur di luar pengadilan). Namun demi terciptanya kepastian hukum perlu dibentuk undang-undang yang mengatur secara khusus, terstruktur, dan komprehensif mengenai perlindungan nasabah, mengharmonisasikan peraturan perundang-undangan yang sudah ada serta memaksimalkan mekanisme yang jelas terkait koordinasi antar penegak hukum untuk menciptakan kepastian hukum. Metode yang digunakan penelitian dalam ini adalah penelitian hukum Normatif Empiris yang didasarkan pada bahan hukum primer dan hukum sekunder. Jenis data penelitian yang digunakan adalah data primer dilakukan dengan penelitian lapangan dengan wawancara kepada responden, yaitu pihak BCA Cabang Perbaungan yang dapat membantu penulis untuk memberikan jawaban atas permasalahan yang penulis teliti dalam penulisan skripsi tersebut. Hasil penelitian ini menunjukkan bahwa upaya preventif yang dilakukan oleh bank BCA mengajukan permohonan kredit dengan melampirkan berkas-berkas yang sudah ditentukan oleh bank,kemudian dilakukan analisis terhadap berkas-berkas tersebut, dilakukan survei secara langsung oleh petugas bank, kemudian dilakukan analisis dan evaluasi berkas-berkas, kemudian baru diputuskan apakah kredit tersebut diterima atau ditolak dalam Penyelesaian kredit macet dalam Kredit Pemilikan Rumah pada BCA Cabang Perbaungan dapat ditempuh dalam 2 (dua) cara, yaitu penyelamatan kredit melalui perundingan kembali antara bank sebagai kreditur dan nasabah peminjam sebagai debitur dan dengan cara penyelesaian kredit macet dalam Kredit Pemilikan Rumah yaitu melalui lembaga hukum, yaitu Panitia Urusan Piutang Negara (PUPN) dan Direktorat Jenderal Piutang dan Lelang Negara (DJPLN).dan hukum sekunder. / This research examines the problem of preventive efforts carried out by BCA bank to apply for credit by attaching the files that have been determined by the bank, then analyzing these files, and conducting a survey directly by bank officers, then analyzing and evaluating the files. file, then it is decided whether the credit is accepted or rejected. The legal remedies that customers can take to carry out legal settlements due to losses arising from the use of this mobile banking service are through litigation (court route) and non-litigation (outside court route). However, in order to create legal certainty, it is necessary to form a law that specifically, structured and comprehensively regulates customer protection, harmonizes existing laws and regulations and maximizes clear mechanisms related to coordination between law enforcers to create legal certainty. The method used in this study is Normative Empirical Legal Research based on primary and secondary legal materials. The type of research data used is primary data collected through field research by interviewing respondents, namely the BCA Perbaungan Branch, who can help the author to provide answers to the problems that the author is researching in writing the thesis. The results of this study show that the preventive efforts made by BCA Bank are to submit a loan application with the files that have been determined by the bank, then an investigation is carried out on the files, a direct survey is carried out by bank officers, then an analysis and evaluation of the files is carried out, then it is decided whether the loan is accepted or rejected. The settlement of NPLs in Home Ownership Loans at BCA Perbaungan Branch can be taken in two ways, namely: saving the loan through renegotiation between the bank as the creditor and the borrower customer as the debtor, and settling NPLs in Home Ownership Loans through legal institutions, namely the National Debt Affairs Committee (PUPN) and the Directorate General of State Debt and Auctions (DJPLN). This research examines the problem of preventive efforts carried out by BCA bank to apply for credit by attaching the files that have been determined by the bank, then analyzing these files, and conducting a survey directly by bank officers, then analyzing and evaluating the files. file, then it is decided whether the credit is accepted or rejected.
