Abstract

Land is one of the factors that influences the progress of a nation's development. Current development and the progress of modern industry encourage economic growth, which can have an impact on increasing housing needs. Meanwhile, land supplies are getting smaller and land prices are increasing. Indonesia as a country that has various potentials can’t avoid challenges in the development process, especially regarding land. The formulation of the problem in this research is how to regulate land banks in terms of Job Creation and Government Law number 6 of 2023 and Land Bank Agencies Regulation number 64 of 2021. The aim of this research is to analyze and discover the implementation of Indonesian land bank, then compare it with Netherlands land bank which have been successful in implementing the land bank system. The method that used in this research is normative legal with a comparative study approach to the implementation of land bank in Indonesia and the Netherlands. The results of this research show that the formation of land bank in Indonesia and the Netherlands has similarities, which both countries aim to increase land consolidation in order to optimize land productivity for the benefit of the general public. The Netherlands uses land banks to develop agricultural and rural land, while recently Indonesia only carries out duties and functions in the housing sector for the welfare of lowincome communities.
