Abstract

Seiring dengan pertumbuhan penduduk yang terus meningkat, kebutuhan rumah menjadi salah satu kebutuhan pokok atau utama manusia. Banyak perusahaan pengembang perumahan bermunculan karena kebutuhan akan tempat tinggal. Mekanisme pemasaran dan penjualan dilakukan oleh agen pemasaran jika pemasaran dan penjualan dilakukan oleh pengembang. Resiko dapat muncul ketika Developer memanfaatkan ketidaktahuan Konsumen atas alur pembayaran yang harus dilakukan kepada Developer dan juga kelalaian Developer untuk melakukan pengawasan terhadap agen pemasaran. Resiko yang dapat terjadi dan merugikan konsumen utamanya bagi yang telah lunas melakukan pembayaran atas transaksi pemesanan Tanah dan Bangunan dan seharusnya menguasai objek dalam transaksi tersebut saat pada kenyataanya agen pemasaran melakukan pengelapan dana pembeli. Lalu bagaimana perlindungan hukum dan juga mekanisme jalannya perlindungan hukum bagi Konsumen yang dananya disalahgunakan atau dalam hal ini terjadi penggelapan dana yang dilakukan oleh agen pemasaran Developer itu sendiri. Dalam Penelitian ini mengkaji dan menganalisa dengan menggunakkan teori normatif yang difokuskan pada teori Keadilan Bermartabat. Bahwa terdapat kedudukan hukum dan perlindungan hukum bagi Konsumen yang telah menjalankan kewajibannya teori Keadilan Bermartabat menjelaskan tentang bahwa seharusnya putusan Mahkamah Agung dapat memanusiakan manusia dan menegakkan keadilan bagi Konsumen yang dirugikan. / As the population continues to grow, the need for a home becomes one of the basic or primary human needs. A lot of housing development companies are emerging because of the need for housing. Marketing and sales mechanisms are carried out by the marketing agency if marketing and sales are done by the developer. The risk can arise when the developer exploits the consumer's ignorance of the payment flow to be made to the Developer as well as the development negligence to carry out surveillance over the marketing agent. The risk that can occur and harm the main consumer is for those who have failed to make payments for the land and building booking transactions and should have mastered the object in the transaction at the time the marketing agency actually carried out the buyer's funds. Then how is the legal protection and also the mechanism of the way of legal protection for consumers whose money is abused or in this case the funds are concealed by the developer's own marketing agency. In this study we study and analyze using normative theory that focuses on the theory of Dignity Justice. That there is a legal position and legal protection for consumers who have performed their duties The theory of Dignity Justice explains that the Supreme Court's ruling should be able to humanize humans and enforce justice for the damaged consumers.
