Abstract

Prostitusi online merupakan pekerjaan yang terkait dengan pelacuran atau pelayanan jasa seksual yang memanfaatkan media sosial untuk sarana komunikasi dan menghubungkan para Pekerja Seks Komersial dengan para penggunanya, media social yang digunakan yaitu aplikasi michat. Aplikasi michat digunakan para Pekerja Seks Komersial untuk menjualkan diri dengan menggunakan foto yang menarik tetapi tidak mengandung konten pornografi tetapi menggunakan simbol-simbol tertentu. Oleh karena itu, PSK tersebut masuk dalam ranah subtansi pornografi berdasarkan Undang-Undang Nomor 44 Tahun 2008 tentang Pornografi. Tugas akhir ini bertujuan untuk menganalisis pertanggungjawaban hukum bagi pekerja seks komersial yang menjual diri tanpa publikasi konten pornografi di aplikasi michat sesuai dengan ketentuan dalam Undang-Undang Nomor 44 Tahun 2008. Dari hasil analisis dalam tugas akhir ini menunjukkan bahwa Pekerja Seks Komersial yang menjual diri tanpa publikasi konten pornografi melainkan terdapat simbol-simbol pada bionya maka dapat dipidana sesuai dengan ketentuan Undang-Undang 44 Tahun 2008 / Online prostitution is work related to prostitution or sexual services that utilizes social media as a means of communication and connecting commercial sex works with their users, the social media used is the Michat application. The Michat application is used by commercial sex workers to sell themselves using attractive photos that do not contain pornographic content but use certain symbols. Therefore, these prostitutes fall into the realm of pornographic substances based on Law Number 44 of 2008 concerning Pornography. This final assignment aims to analyse the legal liability for commercial sex workers who sell themselves without publishing pornographic content on the Michat application in accordance with the provisions in Law Number 44 of 2008. From the results of the analysis in this final assignment shows that Commercial Sex Workers who sell themselves without publication of pornographic content unless there are symbols in the bio can be punished in accordance with the provisions of Law 44 of 2008
