Abstract

Penelitian ini membahas mengenai bentuk tanggung jawab mengenai fenomena influencer yang menyebarkan informasi berupa ajakan pembelian saham di media sosial. Ajakan tersebut mempengaruhi pergerakan harga saham dan penilaian investor dalam melakukan investasi. Tindakan ini membuat investasi saham menjadi berisiko dan membuat investor bersikap spekulatif sehingga membuat investor mengalami kerugian. Pengaruh influencer yang besar membuat keadaan pasar modal menjadi tidak kondusif terutama dalam perdagangan saham. Penelitian ini bertujuan mengetahui bentuk pertanggungjawaban influencer terhadap investor yang dirugikan. Metode yang digunakan dalam penelitian ini adalah metode Yuridis-Normatif yang dilakukan dengan pendekatan perundang-undangan dan pendekatan konseptual Hasil penelitian ini menunjukan bahwa influencer bertanggung jawab atas kerugian investor berdasarkan UU Pasar modal. Perbuatan ini juga dikatagorikan sebagai suatu bentuk perbuatan melawan hukum./ This research discusses forms of responsibility regarding the phenomenon of influencers who spread information in the form of invitations to buy shares on social media. This invitation influences share price movements and investors' judgment in making investments. This action makes stock investments risky and makes investors act speculatively, causing investors to experience losses. The large influence of influencers makes the capital market situation unfavorable, especially in stock trading. This research aims to determine the form of influencer responsibility towards investors who suffer losses. The method used in this research is the Juridical-Normative method which is carried out using a statutory approach and a conceptual approach. The results of this research show that influencers are responsible for investor losses based on the Capital Markets Law. This act is also categorized as a form of unlawful act.
