Abstract

Usia pensiun merupakan usia yang mengindikasikan bahwa seseorang telah melewati umur produktif pada hidupnya, hal ini memiliki dampak besar dalam dunia ketenagakerjaan dimana jika seorang telah mencapai usia pensiun maka kinerjanya juga akan semakin berkurang. Berdasarkan UU Ketenagakerjaan, orang yang pensiun tidak dapat dipekerjakan sebagai pegawai tetap dan dikontrak PKWTT namun harus dikontrak PKWT karena jam kerja yang diatur dalam UU Ketenagakerjaan tidak mungkin untuk diikuti oleh orang yang pensiun. Hal ini seperti kasus yang dialami oleh Dosen “M” yang sudah pensiun namun dipekerjakan kembali sebagai dosen dengan kontrak PKWT dimana pada tahun 2023 PKWT beserta perpanjangannya habis, hal ini tentu menyebabkan Dosen “M” yang sudah pensiun harus dipekerjakan sebagai pegawai tetap dengan kontrak kerja PKWTT. Dalam hal ini jelas bertentangan mengenai PKWTT dan usia Dosen “M” yang telah pensiun. Penelitian ini bertujuan untuk mengetahui apakah akibat hukum dari dosen usia pensiun yang masih bekerja melebihi masa pensiunnya dengan PKWT sesuai Undang-Undang Nomor 14 Tahun 2005 dan hukum positif ketenagakerjaan. Tipe penelitian yang digunakan menggunakan tipe penelitian yuridis normatif dengan menggunakan pendekatan undang-undang dan pendekatan konseptual. Hasil penelitian ini menunjukan bahwa Dosen “M” yang dipekerjakan melebihi usia pensiunnya dengan PKWT, harus dipekerjakan sebagai pegawai tetap dengan kontrak kerja PKWTT yang bertentangan dengan umur produktif Dosen “M”. Retirement age is the age that indicates that a person has passed the productive age of his life. This has a big impact in the world of employment where if a person has reached retirement age, his performance will also decrease. Based on the Labor Law, retired people cannot be employed as permanent employees and contract PKWTT but must be contracted with PKWT because the working hours regulated in the Labor Law are impossible for retired people to follow. This is like the case experienced by Lecturer "M" who had retired but was re-employed as a lecturer with a PKWT contract where in 2023 the PKWT and its extension expired, this of course caused Lecturer "M" who had retired to have to be hired as a permanent employee with a work contract PKWTT. In this case there is a clear conflict regarding PKWTT and the age of Lecturer "M" who has retired. This research aims to find out what the legal consequences are for lecturers of retirement age who are still working beyond their retirement period with PKWT in accordance with Labor Law and positive law. The type of research used is normative juridical research using a statutory approach and a conceptual approach. The results of this research show that Lecturer "M" who is employed beyond his retirement age with PKWT, must be hired as a permanent employee with a PKWTT work contract which is contrary to the productive age of Lecturer "M".
