Abstract

Utang dapat dialihkan dengan 3 cara, dengan novasi, subrogasi, dan Cessie. Cessie dapat diartikan sebagai penyerahan piutang atas nama beserta barang-barang lain dan barang-barang lain yang tidak bertubuh. Cessie ini memiliki pihak antara kreditur awal, kreditur baru, dan debitur. Undang-Undang secara tegas menyatakan tentang syarat- syarat membuat perjanjian cessie yang tercantum pada Pasal 613 KUH Perdata serta tidak mengecualikan Pasal 1320 KUH Perdata. Hal ini pihak bank sebagai kreditur awal dari perjanjian cessie melakukan pelanggaran terhadap syarat-syarat perjanjian cessie. Melalui tugas akhir ini dapat disimpulkan bahwa keabsahan dari perjanjian cessie dalam kasus ini tidak sah dan membuat perjanjian cessie ini dapat dibatalkan oleh pihak yang dirugikan dan pihak bank dapat digugat Pasal 1365 KUH Perdata atas dasar perbuatan melawan hukum. Penelitian tugas akhir ini bertujuan untuk mengetahui akibat hukum dari pembuatan perjanjian cessie yang dilakukan secara sepihak. Metode yang digunakan untuk penelitian ini yaitu yuridis normatif, metode ini mengacu kepada peraturan perundang-undangan, asas-asas, dan yurisprudensi./ Debts can be transferred in three ways: through novation, subrogation, and Cessie. Cessie can be defined as the transfer of a claim along with other corporeal and non- corporeal assets. Cessie involves three parties: the original creditor, the new creditor, and the debtor. The law explicitly specifies the conditions for making a Cessie agreement as stated in Article 613 of the Civil Code and does not exclude Article 1320 of the Civil Code. In this case, the bank, as the original creditor in the Cessie agreement, has violated the terms of the Cessie agreement. This thesis concludes that the validity of the Cessie agreement in this case is not valid, and the Cessie agreement can be annulled by the aggrieved party. The bank can be sued under Article 1365 of the Civil Code for an unlawful act. The purpose of this thesis research is to determine the legal consequences of making a one-sided Cessie agreement. The method used for this research is a normative juridical approach, which refers to legal provisions, principles, and jurisprudence
