Abstract

Penelitian ini membahas mengenai penerapan Undang-Undang Nomor 4 Tahun 1996 tentang Hak Tanggungan terhadap jaminan kredit debitur. Kredit adalah pemberian peminjaman uang dalam jangka waktu tertentu yang diaturdi dalam UU Perbankan dan hak tanggungan merupaka bentuk jaminan yang digunakan pada properti yang diatur di dalam UUHT. Penelitian ini menggunakan metode penelitian yuridis normatif yang dilakukan melalui studi pendekatan kasus.Metode penelitian ini bertujuan untuk menganalisis langkah hukum yang harus ditempuh oleh pihak debitur dalam mendapatkan haknya. Hasil dari penelitian ini di dapatkan bahwa pihak kreditur seharusnya melakukan negosiasi terlebih dahulu terhadap pihak debitur untuk sama-sama melelang objek Hak Tanggungan dibawah tangan agar mendapatkan harga setinggi-tingginya. / This research discusses the implementation of Law Number 4 of 1996 concerning Mortgage Rights on debtor credit guarantees.. Credit is the provision of money lending within a certain period of time regulated in the Banking Law and mortgage rights are a form of collateral used on property regulated in the UUHT. This research uses normative juridical research methods conducted through a case approach study. This research method aims to analyze the legal steps that must be taken by the debtor in obtaining his rights. The results of this research indicate that creditors should negotiate with debtors first to jointly auction the collateral under the mortgage privately, in order to obtain the highest possible price.
