Abstract

Penelitian ini membahas mengenai perlindungan hukum bagi pekerja perempuan hamil,tidak sedikit pekerja perempuan hamil,yang mendapatkan tindakan diskriminasi. Tindakan diskriminasi ini berupa tidak terpenuhinya hak�hak yang sudah seharusnya didapatkan oleh pekerja, contohnya seperti pekerja perempuan hamil yangdituntut untuk bekerja hingga larut malam. Pada dasarnya menurut UU Ketenagakerjaan, pekerja perempuan hamil dilarang untuk bekerja hingga larut malam karena dapat mengganggu kesehatan dari ibu maupun janinnya. Tujuan dari penelitian ini adalah untuk mengetahui perlindungan hukumterhadap hak bagi pekerja perempuan hamil di Indonesia dalam UU Ketenagakerjaan. Tipe penelitian yang digunakan adalah tipe penelitian Yuridis Normatif-Dogmatik dengan menggunakan pendekatan konsep (conceptual approach), pendekatan perundang-undangan (statute approach). Hasil dari penelitian ini menunjukan bahwa, Perusahaan Es Krim PT. A belum sesuai dengan implementasinya karena terbukti telah melanggar hak-hak daripekerja perempuan hamil yang bekerja diperusahaannya. Dalam hasil penelitian ini juga menunukan bahwa masih minimnya kepedulian perusahaan terhadap para pekerjanya. / This research discusses legal protection for pregnant female workers, not a few pregnant female workers are subject to discrimination. This act of discrimination takes the form of not fulfilling the rights that workers should have,for example, pregnant women who are required to work late at night. Basically, according to theManpower Law, pregnant female workers are prohibited from working late at nightbecause it can harm the health of the mother and fetus. The aim of this research is to determine the legal protection of the rights of pregnantwomen workers in Indonesia in the Employment Law. The type of research used isNormative-Dogmatic Juridical research using aconceptual approach and a statutoryapproach. The results of this research show that the Ice Cream Company PT. A has not complied with its implementation because it has been proven to have violated the rights of pregnant female workers who work in his company. The results of this research also show that the company still has minimal concern for its workers.
