Abstract

Pada skripsi ini membahas tentang kasus proyek apartemen mangkrak dimana pihak pengembang melakukan tindakan perbuatan melawan hukum dengan bukti tidak memiliki surat Izin Mendirikan Bangunan (IMB). Pembangunan Rumah Susun merupakan upaya penyediaan rumah bagi masyarakat dalam kondisi keterbatasan lahan. Rumah Susun yang ada saat ini dibangun di atas tanah Hak Milik, Hak Guna Bangunan dan Hak Pakai. Karena keterbatasan tanah hak untuk dibangun rumah susun terutama untuk memenuhi kebutuhan masyarakat berpenghasilan rendah, dalam Undang-undang Nomor 20 Tahun 2011. Dalam skripsi ini menggunakan tipe penelitian yuridis normatif melalui pendekatan Statute Approach, Conceptual Approach, dan, Case Approach. Saran yang penulis berikan dalam penelitian ini adalah konsumen diharapkan bisa mencermati klausul-klausul yang terdapat di dalam perjanjian kemudian pemerintah perlu membuat aturan hukum yang mengatur lebih lanjut mengenai hak-hak kreditur konkuren tujuannya agar dapat meminimalisir kerugian yang ditimbulkan kepada konsumen, selain itu diperlukan keterbukaan informasi dan itikad baik oleh pihak pengembang kepada konsumen apartemen / This thesis discusses the case of a stalled apartment project where the developer committed an unlawful act with evidence of not having a Building Construction Permit (IMB). The construction of flats is an effort to provide houses for people inconditions of limited land. The existing flats are built on land with ownership rights,building use rights and use rights. Due to limited land, the right to build flats is mainly to meet the needs of low-income people, in Law Number 20 of 2011.This thesis uses a normative juridical research type through the Statute Approach, Conceptual Approach, and Case Approach. The advice that the author gives in this research is that consumers are expected to be able to pay attention to the clauses contained in the agreement, then the government needs to make legal regulations that further regulate the rights of concurrent creditors, the aim of which is to minimize losses caused to consumers, apart from that, information disclosure is needed and good faith by the developertowards apartment consumers
