Abstract

Menurut undang-undang yang mengatur umum maupun undang-undang yang khusus menerangkan bahwa korporasi wajiblah bertanggung jawab atas perbuatan pegawainya sebagai mana perbuatan itu dilakukan ketika melakukan kerja. Hal ini sebagaimana dituliskan dalam pasal 1367 ayat (3) Kitab Undang-Undang Hukum Perdata menyatakan bahwa: “Majikan-majikan dan orang yang mengangkat orang lain untuk mewakili urusan-urusan mereka, adalah bertanggung jawab tentang kerugian yang diterbitkan oleh pelayan-pelayan atau bawahan-bawahan mereka didalam melakukan pekerjaan untuk mana orang-orang ini dipakainya.” Hal ini dikarenakan konsumen datang adalah bukan melihat siapakah pegawainya bahkan konsumen tidak memahami bagaimana hubungan antara pegawai dengan perusahaan melainkan lebih berpedoman pada kredibilitas unggul dari perusahaan atau nama baik dari bank tersebut. Peraturan yang khusus mengatur mengenai perbankan diatur dalam Undang-Undang Nomor 10 tahun 1998 tentang perubahan Undang-Undang Nomor 7 Tahun 1992 tentang Perbankan. Dimana dituliskan pada pasal 49 butir a hingga c bank selaku PUJK dapat dikenai sanksi atas perbuatan pegawainya yang dengan sengaja membuat catatan palsu. Namun hal ini berbanding terbalik dengan contoh kasus yang terjadi pada kasus pengadilan negeri Makassar 170/PDT.G/2021/PN MKS dimana bank selaku korporasi atau PUJK tidak bertanggungjawab atas perbuatan yang dilakukan oleh pegawai nya meskipun merugikan nasabah atau konsumen perbankannya. Penelitian ini menggunakan metode yuridis normative yang menggunakan studi Pustaka. Hasil dari penelitian ini adalah bahwa bank wajib bertanggung jawab atas hilangya dana deposito nasabahnya karena perbuatan pegawainya. Hal ini didasarkan pasal 7 dan 8 Peraturan Otoritas Jasa Keuangan Republik Indonesia Nomor 6 / POJK.07/2022 Tentang Perlindungan Konsumen dan Masyarakat Di Sektor Jasa Keuangan / According to general laws and specific laws, it is clear that corporations are obliged to be responsible for the actions of their employees, as those actions are carried out while carrying out work. This is as written in article 1367 paragraph (3) of the Civil Code which states that: "Employers and people who appoint other people to represent their affairs, are responsible for losses incurred by servants or subordinates. their subordinates in carrying out the work for which these people are used.” This is because consumers come not to see who the employees are. In fact, consumers do not understand the relationship between employees and the company but are more guided by the superior credibility of the company or the good name of the bank. Specific regulations governing banking are regulated in Law Number 10 of 1998 concerning amendments to Law Number 7 of 1992 concerning Banking. As written in article 49 points a to c, banks as PUJK can be subject to sanctions for the actions of their employees who deliberately create false records. However, this is in contrast to the example of the case that occurred in the Makassar district court case 170/PDT.G/2021/PN MKS where the bank as a corporation or PUJK was not responsible for actions committed by its employees even though they were detrimental to their customers or banking consumers. This research uses normative juridical method using literature study. The results of this research are that banks must be responsible for the loss of their customers' deposit funds due to the actions of their employees. This is based on the articles 7 and 8 paragraph (1) of the Republic of Indonesia Financial Services Authority Regulation Number 6 / POJK.07/2022 concerning Consumer and Public Protection in the Financial Services Sector
