Abstract

Tujuan dari penelitian skripsi ini dilakukan oleh peneliti dengan judul Akibat Hukum Putusan Pailit Terhadap PT. Asuransi Jiwa Kresna (Studi Putusan Nomor 647 K/Pdt.Sus-Pailit/2021) ditujukan untuk mengetahui dan memahami tentang akibat hukum dapat ditimbulkan dari adanya putusan pailit terhadap suatu perusahaan asuransi yang berdampak terhadap nasabah dan terhadap perusahaan itu sendiri. Penelitian skripsi ini menggunakan jenis metode penelitian hukum normatif yang diperoleh dari hasil kepustakaan yakni undang-undang, buku, jurnal, dan sumber pustaka lainnya. Jenis data yang digunakan berupa data primer dan data sekunder yang terbagi atas bahan hukum primer, bahan hukum sekunder dan bahan hukum tersier. Cara perolehan data dilakukan dengan pengumpulan bahan hukum yang akan dikaji serta analisis kasus berdasakan peraturan perundang-undangan yang dilakukan dengan metode studi kepustakaan. Analisis data hasil penelitian ini menggunakan jenis penelitian hukum normatif, artinya penelitian ini memandang dan menemapatkan hukum sebagai ilmu yang berdiri sendiri dan menempatkan kebenaran berdasarkan logika keilmuan dari sisi normatifnya. Hasil penelitian dari penelitian skripsi ini adalah kepailitan yang dialami PT. Asuransi Jiwa Kresna akan semakin mempersulit posisi nasabah untuk menerima manfaatnya dikarenakan dalam kepailitan, perusahaan sudah tidak berwenang atas hartanya dan kewenangan atas pengurusan harta ini akan beralih kepada kurator. Umumnya, kurator memerlukan waktu yang lama untuk dapat melikuidasi harta pailit. Ditambah, setelah dilikuidasi, hasil likuidasi ini akan dikurangi dengan beberapa biaya seperti biaya kurator dan pajak. Sehingga persen penerimaan nasabah menjadi lebih sedikit. Sebagai bentuk tanggung jawab, debitur dapat mengajukan Rencana Penyehatan Keuangan (RPK) kepada OJK sebagai langkah untuk memenuhi kewajibannya / This purpose of this study research conducted by researcher with the title on The Legal Consequences Of Bankruptcy Verdict Of PT. Asuransi Jiwa Kresna From The Case Study 647 K/Pdt.Sus-Pailit/2021 is intended to find out and to understand about the legal consequences of a bankruptcy verdict which will make an impact on an insurance company from the customer to the own company. This research uses normative legal research which is obtained from literature study such as law, books, journals, and other library sources. Data type which is used in this research consists of primary data and secondary data that are divided to primary legal materials, secondary legal materials, tertiary legal materials. The data was collected by accumulating law materials which will be studied further and analyzing case against law and reguations and will be carried out using literature study method. The results of data analysis of this study uses normative legal research, meaning this study views and places law as an independent knowledge and the truth is based on scientific logic from normative perspective. The results of this study s bankruptcy experienced by PT. Kresna Life Insurance will make it even more difficult for customers to receive benefits because in bankruptcy, the company will no longer have authority over their assets and authority over managing these assets will shift to the curator. Generally, curators need a long time to liquidate bankruptcy assets. Plus, after liquidation, the liquidation proceeds will be reduced by several costs such as curator fees and taxes. So the percentage of customer acceptance is lower. As a form of responsibility, insurance company will submit Financial Recovery Plan as a step to fulfill their obligation.
