Abstract

Penelitian ini bertujuan untuk menganalisis perlindungan hukum bagi calon pekerja selama pelaksanaan pelatihan vokasi. Pelatihan vokasi menjadi bagian integral dari persiapan calon pekerja untuk memasuki dunia kerja. Namun, seringkali terdapat potensi risiko hukum yang dapat mempengaruhi calon pekerja selama periode pelatihan. Penelitian ini menggunakan metode analisis yuridis normatif dan study literatur untuk mengevaluasi kerangka hukum yang mengatur pelaksanaan pelatihan vokasi di Indonesia dan menganalisis dampaknya terhadap perlindungan calon pekerja. Adapun yang menjadi permasalahan adalah bentuk perlindungan hukum bagi peserta pelatihan Vokasi menurut hukum Indonesia dan bagaimana upaya hukum bagi peserta pelatihan Vokasi yang mengalami kerugian menurut hukum Indonesia. Hasil penelitian ini menyoroti kebutuhan untuk memperkuat kerangka hukum yang melindungi calon pekerja selama pelatihan vokasi. Faktor-faktor seperti kontrak pelatihan, hak dan kewajiban calon pekerja, serta tanggung jawab perusahaan dalam memastikan lingkungan pelatihan yang aman dan mendukung menjadi fokus utama analisis. Selain itu, penelitian ini memberikan rekomendasi untuk perbaikan dan pengembangan kebijakan yang dapat meningkatkan perlindungan hukum calon pekerja perusahaan dan mungkin juga menjadi masukan bagi berbagai pihak terkait dengan pelaksanaan perlindungan hukum para calon pekerja secara lebih komprehensif. Dari hasil penelitian ini masih belum ada payung hukum yang khusus dan focus memberikan perlindungan hukum bagi peserta vokasi, untuk memperkuat dan mempertegas pelaksanaan vokasi penting untuk membuat perjanjian yang memuat berbagai dasar hukum yang dibutuhkan. Pemerintah hingga saat ini telah menunjuk KADIN (Kamar Dagang Indonesia) untuk menjembatani pelaksanaan pelatihan vokasi tersebut. Kedepannya diharapkan penelitian ini dapat memberikan kontribusi pada pengembangan pemahaman hukum terkait pelatihan vokasi dan memberikan dasar bagi perusahaan dan berbagai pihak terkait dalam hal ini KADIN bersama dengan Pemerintah untuk meningkatkan perlindungan calon pekerja selama proses pelatihan./This research aims to analyse the legal protection for prospective workers during the implementation of vocational training. Vocational training is an integral part of the preparation of prospective workers to enter the world of work. However, there are often potential legal risks that can affect prospective workers during the training period. This research uses the normative juridical analysis method and literature study to evaluate the legal framework governing the implementation of vocational training in Indonesia and analyse its impact on the protection of prospective workers. The problem is the form of legal protection for vocational training participants according to Indonesian law and how legal remedies for vocational training participants who suffer losses according to Indonesian law. The results of this study highlight the need to strengthen the legal framework that protects prospective workers during vocational training. Factors such as training contracts, the rights and obligations of trainees, and the responsibilities of companies in ensuring a safe and supportive training environment are the main focus of the analysis. In addition, this research provides recommendations for improvements and policy development that can enhance the legal protection of prospective company workers and may also serve as input for various parties related to the implementation of legal protection of prospective workers in a more comprehensive manner. From the results of this study, there is still no specific legal umbrella and focus on providing legal protection for vocational participants, to strengthen and reinforce the implementation of vocational training it is important to make agreements that contain various legal bases needed. The government has appointed KADIN (Indonesian Chamber of Commerce) to bridge the implementation of vocational training. In the future, it is hoped that this research can contribute to the development of legal understanding related to vocational training and provide a basis for companies and various related parties in this case KADIN together with the Government to improve the protection of prospective workers during the training process.
