Abstract

Kajian-kajian tentang Rohingya sudah cukup banyak ditemukan, namun kajian tersebut lebih terfokus kepada faktor yang menyebabkan status stateless anak lahir dari perkawinan campuran Rohingya. Disertasi ini menyuguhkan hal yang berbeda, yakni lebih dari perihal kajian kritis rekonstruksi perlindungan hukum bagi anak yang lahir dari perkawinan campuran antara Warga Negara Indonesia dengan pengungsi Rohignya di Medan. Perkawinan campuran dengan pengungsi Rohingya ini akan semakin bertambah ke depannya, hal ini memberikan dampak yang sangat besar dengan generasi bangsa Indonesia ke depannya terutama status anak sebagai warga negara. Permasalahan dalam disertasi ini adalah: 1) Bagaimana pengaturan pelaksanaan hukum perkawinan campuran berdasarkan hukum positif di Indonesia? 2) Bagaimana pelaksanaan perlindungan hukum terhadap anak yang lahir dari perkawinan campuran Warga Negara Indonesia dengan pengungsi Rohingya yang berstatus stateless person? 3) Bagaimana rekonstruksi perlindungan hukum bagi anak di Indonesia ke depan?. Metode penelitian yang digunakan adalah yuridis empiris. Penelitian lapangan dilakukan guna memperoleh data primer dengan instrument penelitian berupa wawancara, observasi, serta data yang diambil dari Kemenkumham, UNHCR, IOM, dan Shelter Camp Hotel Pelangi Kota Medan. Hasil penelitian menunjukkan bahwa masih lemahnya hukum positif di Indonesia dan status hukum anak yang lahir dari perkawinan campuran Warga Negara Indonesia dengan pengungsi Rohingya yang berstatus stateless dalam hukum nasional, dan internasional secara garis besar belum memberikan perlindungan terhadap status hukum anak. Novelty disertasi ini pembaharuan undang-undang kewarganegaraan pada Pasal 19A yaitu memberikan perlindungan terhadap orang- orang stateless melalui Naturalisasi yang telah mendiami 10 tahun dan mempunyai anak. Dan perlunya anak mendapatkan kepastian hukum atas legal status kewarganegaraan serta mengambil langkah-langkah proaktif seperti pengumpulan data kependudukan untuk mengurangi situasi kewarganegaraan di Indonesia/There have been many studies on Rohingya, but these studies are more focused on the factors that cause the stateless status of children born from mixed marriages of Rohingya. This dissertation presents something different, which is more than a critical study of the reconstruction of legal protection for children born from mixed marriages between Indonesian citizens and Rohingya refugees in Medan. Mixed marriages with Rohingya refugees will increase in the future, this has a huge impact on the future generation of the Indonesian nation, especially the status of children as citizens. The problems in this dissertation are: 1) How is the regulation of the legal implementation of mixed marriage based on positive law in Indonesia? 2) How is the implementation of legal protection for children born from mixed marriages of Indonesian citizens with Rohingya refugees who have the status of stateless persons? 3) How is the reconstruction of legal protection for children in Indonesia in the future? The research method used is empirical juridical. Field research was conducted to obtain primary data with research instruments in the form of interviews, observations, and data taken from the Ministry of Law and Human Rights, UNHCR, IOM, and Shelter Camp Hotel Pelangi Medan City. The results show that the positive law in Indonesia is still weak and the legal status of children born from mixed marriages of Indonesian citizens with Rohingya refugees who have stateless status in national and international law has not provided protection for the legal status of children. The novelty of this dissertation is the renewal of the citizenship law in Article 19A, which provides protection to stateless people through Naturalization who have lived for 10 years and have children. And the need for children to get legal certainty over the legal status of citizenship and take proactive steps such as collecting population data to reduce the situation of citizenship in Indonesia
