Abstract

Freeport telah beroperasi di Indonesia sejak 50 tahun yang lalu. Freeport juga merupakan perusahaan internasional pertama yang melakukan investasi di Indonesia. Tak dapat dipungkiri, hal itu berdampak terus menerus bagi masyarakat Indonesia terutama masyarakat Papua. Ada banyak argumen mengenai operasi Freeport di Papua yang menyangkut kesejahteraan masyarakat lokal. Perpanjangan kontrak antara Freeport dan Indonesia telah terjadi beberapa kali. Penelitian ini bertujuan untuk menggambarkan perselisihan perpanjangan kontrak Freeport pada tahun 2015-2017. Secara khusus, untuk menggambarkan perselisihan utama antara Freeport dan pemerintah pusat Indonesia pada tahun 2015-2017, upaya yang dilakukan untuk menyelesaikan masalah, dan hasil yang telah dicapai mengenai sengketa tersebut. Diharapkan penelitian ini dapat memberikan penjelasan yang jelas bagi masyarakat dalam memahami konflik Freeport dengan pemerintah Indonesia. Penelitian ini menggunakan pendekatan kualitatif, dan menggunakan metode analisis deskriptif. Konsep yang digunakan untuk analisis dalam penelitian adalah teori konflik, kepentingan nasional, kebijakan pemerintah mengenai pertambangan, dan teori penyelesaian sengketa. Studi ini menemukan bahwa perselisihan utama perpanjangan ijin kerja Freeport adalah perubahan izin kerja Freeport terhadap Izin Usaha Pertambangan Khusus, pembangunan smelter, divestasi saham dan stabilitas investasi. Negosiasi jangka pendek dan negosiasi jangka panjang telah berlangsung dari 10 Februari sampai 10 Oktober 2017 untuk menyelesaikan masalah ini. Hingga Agustus 2017, Freeport dan pemerintah telah setuju terhadap dua isu utama, yaitu pembangunan smelter dan perubahan kontrak karya menjadi izin usaha pertambangan khusus. / Freeport has been operated in Indonesia since 50 years ago. It is also the first international corporation that conduct investment in Indonesia. Undeniable, it had a continuous impact for Indonesian communities especially peoples of Papua. There are a lot of arguments regarding Freeport’s operation in Papua concerning the welfare of local people. Contract extension between Freeport and Indonesia had occurred for several times. This research is aimed to describe Freeport’s contract renewal disputes in 2015-2017. In particular, to describe the main disputes between Freeport and the central government of Indonesia in 2015-2017, the efforts that are being made to resolve the problem, and the outcomes that have been achieved regarding the disputes. It is expected that this research provides a comprehensive description of Freeport’s disputes with the government of Indonesia. This research applies qualitative approach, and uses descriptive analysis method. Concepts used for analysis in this research are conflict theory, national interest, government policy on mining, and the dispute settlement theory. This study finds that the main dispute of Freeport’s working permit extension which are changes of Freeport’s Contract of Work license to Special Mining Business Permit, the construction of smelters, divestment of shares and investment stability. Short-term negotiation and long-term negotiations has been occurred from February 10 to October 10, 2017 to solve the issue. Until August 2017, Freeport and government has reached common ground for two main issues, which is the construction of smelter and the changes of contract of work to special mining business permit.
