Abstract

Based on article 37 of Law No. 1 of 1974 concerning marriages, marriages terminated due to divorce, joint property is regulated according to their respective laws. The distribution of inheritance which caused conflict in the family, the background of this research is the world heritage and the inheritance of the heirs who are one wife / widow, one son and three daughters, and the land search building area of 1953M2, now want to do the division Inheritance are two daughters who are denied or not reached the distribution of inheritance, as a result of not reaching an agreement in deliberations approved by the religious court, viewed from the background of the Muslim family and reviewed through a compilation of Islamic law. This study describes the distribution of shared assets after taking into account the death of the testator and explains the settlement of inheritance that has not been distributed based on PA Decision No. 0599 / pdt.G / 2012 / PA JS. In this study, the type of research method used is the type of normative research with qualitative data analysis. From the results of the research, divorce due to the death of the testator then for the distribution of rights to shared assets in Indonesia both BW Law, Compilation of Islamic Law and customary law separately for couples who live longer, and for filing a dispute over inheritance that has not been distributed to the heirs approved not found the results of the agreement to settle the distribution of inheritance for Islamic religion can be resolved through the local religious court, and based on the decision pa no0599 / pdt.g / 2012 / pk old JS then the inheritance can be distributed based on the Compilation of Islamic Law. / Berdasarkan pasal 37 UU No 1 tahun 1974 tentang perkawinan, putusnya perkawinan karena perceraian, harta bersama diatur menurut hukumnya masing-masing. Pembagian harta warisan menyebabkan konflik dalam keluarga, latar belakang dalam penelitian ini terdapat suami yang meninggal dunia dan meninggalkan ahli waris yaitu satu istri/janda, satu anak laki-laki serta tiga anak perempuan, dan tanah beserta bangunan seluas 1953M2, pada saat ingin dilakukan pembagian harta warisan terdapat dua anak perempuan yang menolak atau tidak tercapainya pembagian harta waris, akibat tidak tercapainya kesepakatan dalam musyawarah yang berwenang adalah pengadilan Agama, dilihat dari latar belakang keluarga yang beragama Islam dan ditinjau melalui Kompilasi Hukum Islam. Penelitian ini menjelaskan bagaimana pembagian harta bersama setelah adanya kematian pewaris dan menjelaskan penyelesaikan sengketa harta warisan yang belum dibagikan berdasarkan Putusan PA No.0599/pdt.G/2012/PA JS. Dalam penelitian ini, jenis metode penelitian yang dipakai adalah jenis penelitian normatif dengan analisis data kualitatif. Dari hasil penelitian, bahwa perceraian akibat kematian pewaris maka untuk pembagian hak atas harta bersama secara umum di Indonesia baik Hukum BW, Kompilasi Hukum Islam dan Hukum adat adalah separuh kepada pasangan yang hidup lebih lama, dan untuk penyelesaian sengketa harta warisan yang belum dibagikan kepada ahli waris apabila tidak ditemukan hasil musyarawah untuk menyelesaikan pembagian harta warisan bagi yang Agama Islam dapat diselesaikan melalui Pengadilan Agama setempat, dan berdasarkan dari Putusan PA No.0599/pdt.G/2012/PA JS adalah harta bersama terlebih dahulu dibagikan kepada pasangan yang hidup lebih lama maka harta warisan dapat dibagikan berdasarkan Kompilasi Hukum Islam.
