Abstract

Kasus Muhyani, yang dihukum karena penganiayaan yang mengakibatkan kematian oleh Pengadilan Tinggi Banten, dipertanyakan atas dasar kebenaran putusan tersebut. Dakwaan terhadap Muhyani menggunakan Pasal 351 ayat (3) KUHP, yang merupakan pembenaran atas tindakan pidana untuk membela diri sebagaimana diatur dalam Pasal 49 ayat (1) KUHP. Hasil penelitian menunjukkan bahwa tindakan yang dilakukan oleh Muhyani dapat dibenarkan secara hukum karena memperhatikan asas proporsionalitas, yaitu membela diri dari serangan dengan golok oleh Waldi, serta asas subsidiaritas dengan menggunakan gunting yang tersedia di sekitarnya tanpa persiapan sebelumnya. Namun, putusan akhir pengadilan tetap menghukum Muhyani dengan pidana tujuh tahun penjara berdasarkan Pasal 351 KUHP / Case of Muhyani, who was sentenced for assault resulting in death by the High Court of Banten, is questioned based on the correctness of the verdict. The accusation against Muhyani uses Article 351 paragraph (3) of the Criminal Code, which justifies criminal actions for self-defense as regulated in Article 49 paragraph (1) of the Criminal Code. The research results show that Muhyani's actions can be legally justified because they adhere to the principle of proportionality, namely defending oneself from an attack with a machete by Waldi, and the principle of subsidiarity by using scissors available nearby without prior preparation. However, the final court decision still sentenced Muhyani to seven years in prison based on Article 351 of the Criminal Code
