Abstract

Korban tindak pidana penganiayaan merupakan korban yang memikul beban yang sangat banyak baik secara moral ataupun fisik. Skripsi ini menggunakan metode yuridis normatif dengan tujuan mengetahui dan memahami apakah korban penganiayaan sudah mendapatkan pemulihan berdasarkan perspektif HAM dan KUHP di Indonesia. Pendekatan masalah yang digunakan dalam penelitian ini adalah berdasarkan Statute Approach dan Conceptual Approach. Hal ini dijadikan dasar untuk meninjau lebih dalam terkait hak-hak yang didapatkan korban tindak pidana penganiayaan, serta mendalami apa saja yang seharusnya dilakukan oleh korban tindak pidana penganiayaan yang telah dilanggar hak asasi manusianya, dan untuk mengetahui dan memahami langkah-langkah yang harus dilakukan oleh korban pelecehan dari sudut pandang hak asasi manusia, salah satunya melakukan pengaduan ke Komnas HAM. / Victims of criminal acts of abuse are victims who carry a huge burden both morally and physically. This thesis uses normative juridical methods with the aim of knowing and understanding whether victims of abuse have received recovery based on the perspective of human rights and the Criminal Code in Indonesia. The problem approach used in this research is based on the Statute Approach and Conceptual Approach. This is used as a basis for reviewing more deeply the rights obtained by victims of criminal acts of abuse, as well as exploring what victims of criminal acts of abuse whose human rights have been violated should do, and to know and understand the steps that must be taken by victims of harassment from a human rights perspective, one of whom filed a complaint with Komnas HAM.
