Abstract

Maintaining healthy and fair competition is crucial for economic growth. In Indonesia, this principle is governed by Law Number 5 concerning the Prohibition of Monopolistic Practices and Unfair Business Competition. The Business Competition Supervisory Commission (KPPU) was established to oversee and enforce this law. In its implementation, indirect evidence is used to identify violations of business competition. KPPU's authority includes supervision, law enforcement, and providing advice. To support this authority, adequate regulations are needed to ensure transparency and accountability. KPPU Regulation Number 2 of 2023 emphasizes the need for an adaptive and responsive regulatory framework. This change aims to simplify procedures, increase efficiency, and ensure that competition law enforcement remains effective and relevant. This study emphasizes the role of KPPU and the importance of indirect evidence in identifying and addressing anti-competitive behavior, as well as the need for an adaptive regulatory approach in an ever-changing economic landscape. / Menjaga persaingan sehat dan adil penting untuk pertumbuhan ekonomi. Di Indonesia, prinsip ini diatur dalam Undang-Undang Nomor 5 Tahun Tentang Larangan Praktek Monopoli dan Persaingan Usaha tidak Sehat. Komisi Pengawas Persaingan Usaha (KPPU) dibentuk untuk mengawasi dan menegakkan hukum ini. Dalam pelaksanaannya, bukti tidak langsung digunakan untuk mengidentifikasi pelanggaran terhadap persaingan usaha. Kewenangan KPPU antara lain melakukan pengawasan, penegakan hukum, dan pemberi saran. Untuk menunjang kewenangan tersebut diperlukan peraturan yang memadai untuk memastikan transparansi dan akuntabilitas. Peraturan KPPU Nomor 2 Tahun 2023 menekankan kebutuhan kerangka regulasi yang adaptif dan responsif. Perubahan ini bertujuan menyederhanakan prosedur dan meningkatkan efisiensi, serta memastikan penegakan hukum persaingan tetap efektif dan relevan. Studi ini menekankan peran KPPU dan pentingnya bukti tidak langsung dalam mengidentifikasi dan mengatasi perilaku anti-persaingan, serta perlunya pendekatan regulasi yang adaptif dalam lanskap ekonomi yang terus berubah.
