Abstract

Penelitian ini fokus pada penerapan diversi dalam proses penyidikan di Polres Metro Jakarta Timur terhadap anak yang berhadapan dengan hukum. Diversi diatur dalam Undang-Undang Nomor 11 Tahun 2012 tentang Sistem Peradilan Pidana Anak. Dalam konteks ini, penerapan peradilan yang bermartabat sangat penting untuk memastikan bahwa diversi dapat memberikan perlindungan dan pemulihan bagi anak-anak yang berhadapan dengan hukum, sekaligus mencegah stigmatisasi dan kriminalisasi yang berkepanjangan terhadap mereka. Metodologi penelitian yang digunakan adalah kualitatif dengan menggunakan pendekatan normatif- empiris dengan data primer diperoleh melalui wawancara dengan Iptu Sri Yatmini yang menjabat Kepala Unit Perlindungan Anak dan Perempuan Polres Metro Jakarta Timur. Data sekunder meliputi bahan hukum primer, sekunder, dan tersier. Dari hasil penelitian disimpulkan bahwa jumlah pengajuan diversi di Polres Metro Jakarta Timur masih sangat kecil yaitu 20% dari tahun 2018-2023. Hasil tersebut masih sangat kecil dan belum sesuai dengan harapan undang-undang. Respon pertama yang dapat diberikan adalah perlunya sosialisasi dan pemahaman yang kuat kepada aparat penegak hukum dan masyarakat, agar semua pihak dapat memberikan kontribusi terbaiknya terhadap anak yang berhadapan dengan hukum. Kedua, membangun hubungan antar lembaga agar tidak hanya membantu anak melakukan pengawasan, namun juga melakukan pembinaan sejak awal pendidikan di keluarga, sekolah, masyarakat, serta aparat penegak hukum yang ikut serta dalam proses Diversi. / This research focuses on the implementation of diversion in the investigation process at the East Jakarta Metro Police for children in conflict with the law. Diversion is regulated in Law Number 11 of 2012 concerning the Juvenile Criminal Justice System. In this context, the implementation of dignified justice is crucial to ensure that diversion can offer protection and recovery for children in conflict with the law, while also preventing prolonged stigmatization and criminalization against them. The research methodology employed is qualitative, utilizing a normative- empirical approach with primary data obtained through interviews with Iptu Sri Yatmini, who serves as the Head of the Child and Women Protection Unit at East Jakarta Metro Police. Secondary data includes primary, secondary, and tertiary legal materials. From the research results, it was concluded that the number of diversion applications in the East Jakarta Metro Police is still very small, namely 20% from 2018-2023. These results are still very small and not in line with the expectations of the law. The first response that can be given is that strong socialization and understanding is needed law enforcement officials and the public, so that all parties can make the best contribution to the child you are dealing with law. The second is build relationships between institutions to not only help children carry out monitoring, but also provide guidance from the start of education in families, schools, communities, as well as law enforcement officers who take part in the process Diversion.
