Abstract

Kemajuan teknologi dalam Industri 4.0 berdampak luas pada ilmu pengetahuan, bisnis, industri, dan pemerintahan. Inovasi mencakup robotika AI, bioteknologi, pencetakan 3D, IoT, blockchain, dan komputasi kuantum. Industri 4.0 diharapkan memberikan manfaat positif, meningkatkan aksesibilitas transportasi melalui layanan ojek online untuk menggerakkan perekonomian. Selain itu, membuka peluang pengembangan universal. Penggunaan AI yang berkembang pesat saat ini telah terintegrasi dengan mulus dalam berbagai aspek kehidupan manusia. Ini akan secara mendalam membentuk aspek-aspek manusia di masa depan. Penelitian ini bertujuan untuk dapat mengetahui apakah hukum di Indonesia dapat memberikan perlindungan hukum terhadap suatu produk yang sudah memiliki hak cipta dari penggunaan Artificial Intelligence tanpa seizin penciptanya, mengkaji apakah hukum di Indonesia bisa mengatur mengenai Artificial Intelligence, dan untuk mengetahui apa usaha pemerintah untuk memaksimalkan regulasi mengenai Artificial Intelligence. Metode yang digunakan adalah metode penelitian normatif. Penelitian ini menyimpulkan bahwa karya digital, termasuk yang dihasilkan oleh kecerdasan buatan (AI), dilindungi oleh Undang-Undang Nomor 28 Tahun 2014 jika memenuhi standar orisinalitas dan relevansi. Tanggung jawab atas pelanggaran hak cipta oleh AI umumnya berada pada pemegang hak cipta, tetapi bisa juga diterapkan pada pengguna AI. Disarankan untuk menambahkan klausul Work Made For Hire (WMFH) dalam undang-undang tersebut. Pemerintah Indonesia sedang menyiapkan Strategi Nasional AI dan regulasi terkait untuk mengatur penggunaan AI di berbagai sektor. Selain itu, Surat Edaran Menkominfo Nomor 9 Tahun 2023 tentang Etika AI telah dikeluarkan untuk memberikan pedoman bagi pelaku usaha dan pengguna sistem elektronik. / Technological advancements in Industry 4.0 have a broad impact on science, business, industry, and government. Innovations include AI robotics, biotechnology, 3D printing, IoT, blockchain, and quantum computing. Industry 4.0 is expected to provide positive benefits, enhancing transportation accessibility through online motorcycle taxi services to boost the economy. Additionally, it opens opportunities for universal development. The rapid growth of AI is now seamlessly integrated into various aspects of human life, profoundly shaping human aspects in the future. This research aims to determine whether Indonesian law can provide legal protection for products that already have copyrights from the use of Artificial Intelligence without the creator's permission, examine whether Indonesian law can regulate Artificial Intelligence, and to understand the government's efforts to maximize regulations regarding Artificial Intelligence. The method used is normative research. The study concludes that digital works, including those generated by Artificial Intelligence (AI), are protected by Law Number 28 of 2014 if they meet the standards of originality and relevance. Responsibility for copyright infringement by AI generally lies with the copyright holder, but it can also be applied to AI users. It is suggested to add a Work Made For Hire (WMFH) clause to the law. The Indonesian government is preparing a National AI Strategy and related regulations to govern the use of AI in various sectors. Additionally, Minister of Communication and Information Circular Letter Number 9 of 2023 on AI Ethics has been issued to provide guidelines for business actors and electronic system users.
