Abstract

Peraturan Validasi IMEI yang ditetapkan di Indonesia, diberlakukan dalam rangka menekan peredaran ponsel ilegal yang marak beredar di pasar Indonesia, serta untuk melindungi konsumen dan perekonomian negara. Pertanyaan penelitian adalah bagaimana peraturan menteri terkait validasi IMEI untuk mencegah peredaran ponsel ilegal di Indonesia dan bagaimana dampak dari regulasi Validasi IMEI di Indonesia. Tujuan dari penelitian ini adalah untuk mengetahui dan menganalisis Peraturan Menteri Komunikasi dan Informatika Nomor 1 Tahun 2020 dan untuk mengetahui dan menganalisis dampak dari implementasi peraturan menteri tersebut. Dengan jenis penelitian yuridis normatif yaitu penelitian hukum kepustakaan dengan sumber bahan hukum primer, sekunder, dan tersier. Hasil penelitian ini menunjukkan bahwa layanan unlock IMEI merupakan salah satu kendala dalam mencegah peredaran ponsel ilegal di Indonesia. Dalam kerangka teori hukum sebagai sarana pengendalian sosial, regulasi dan penegakan hukum memainkan peran penting dalam mengatur perilaku masyarakat untuk mengurangi praktik-praktik ilegal. Oleh karena itu, penegakan hukum yang tegas dan kerja sama antarlembaga sangat dibutuhkan agar pemerintah dapat mengatasi jasa unlock IMEI dan memastikan regulasi validasi IMEI dapat berjalan dengan efektif. / The IMEI Validation regulation set in Indonesia was enacted in order to suppress the circulation of illegal mobile phones that are rampant in the Indonesian market, as well as to protect consumers and the country's economy. The research question is how the ministerial regulation related to IMEI validation to prevent the circulation of illegal mobile phones in Indonesia and how the impact of the IMEI Validation regulation in Indonesia. The purpose of this research is to find out and analyse the Minister of Communication and Information Technology Regulation Number 1 of 2020 and to find out and analyse the impact of the implementation of the ministerial regulation. With the type of normative juridical research, namely library legal research with primary, secondary, and tertiary legal sources. The results of this study indicate that the IMEI unlock service is one of the obstacles in preventing the circulation of illegal mobile phones in Indonesia. Within the framework of legal theory as a means of social control, regulation and law enforcement play an important role in regulating community behaviour to reduce illegal practices. Therefore, strict law enforcement and inter-agency cooperation are needed so that the government can overcome unlock IMEI services and ensure IMEI validation regulations can run effectively.
