Abstract

Penggunaan Artificial Intelligence (AI) dalam dunia kerja di Indonesia telah menjadi perhatian utama karena potensinya untuk menggantikan peran Sumber Daya Manusia (SDM). Meskipun banyak perusahaan telah mengadopsi Artificial Intelligence untuk meningkatkan efisiensi dan mengurangi kesalahan manusia, regulasi yang mengatur batasan dan dampak penggunaannya masih kurang spesifik. Keberadaan Undang-Undang Informasi dan Transaksi Elektronik (UU ITE) tidak cukup untuk menangani isu yang timbul sehubungan dengan Artificial Intelligence, sehingga menciptakan ketidakpastian hukum yang berpotensi berdampak sosial dan ekonomi yang serius, seperti tingginya angka pengangguran. Data menunjukkan bahwa negara-negara berkembang, termasuk Indonesia, menghadapi risiko tinggi terkait Artificial Intelligence. Oleh karena itu, penting bagi pemerintah Indonesia untuk segera menetapkan regulasi yang jelas dan terperinci mengenai penggunaan Artificial Intelligence dalam dunia kerja guna mencegah ketidakpastian hukum dan dampak negatif di pasar tenaga kerja. Tujuan penelitian ini adalah untuk mengetahui pengaturan hukum penggunaan Artificial Intelligence di Indonesia dan untuk mengetahui urgensi kepastian hukum bagi pekerja yang keahliannya dapat digantikan oleh Artificial Intelligence sehingga pekerja tetap terlindungi Metode penelitian yang digunakan adalah metode penelitian hukum normatif. Hasil penelitian menunjukkan bahwa pengaturan hukum terkait Artificial Intelligence di Indonesia masih belum memadai. Regulasi yang ada, seperti UU ITE dan PP PSTE, belum secara spesifik mencakup Artificial Intelligence, sehingga menimbulkan ketidakpastian hukum bagi masyarakat dan pelaku industri. Perlindungan hukum bagi pekerja yang berpotensi digantikan oleh Artificial Intelligence juga masih kurang, memerlukan regulasi yang lebih rinci untuk memastikan adanya keadilan dan perlindungan yang memadai. / The use of Artificial Intelligence (AI) in the workplace in Indonesia has become a primary concern due to its potential to replace Human Resources (HR). Despite many companies adopting Artificial Intelligence to enhance efficiency and reduce human errors, regulations governing its boundaries and impacts remain insufficiently specific. The presence of the Electronic Information and Transactions Law (ITE Law) is inadequate to address emerging issues related to Artificial Intelligence, thereby creating legal uncertainties that could potentially lead to serious social and economic impacts, such as high unemployment rates. Data indicates that developing countries, including Indonesia, face high risks associated with Artificial Intelligence. Therefore, it is crucial for the Indonesian government to promptly establish clear and detailed regulations regarding the use of Artificial Intelligence in the workplace to prevent legal uncertainties and negative impacts on the labor market. The purpose of this study is to understand the legal regulation of Artificial Intelligence usage in Indonesia and to determine the urgency of legal certainty for workers whose skills could be replaced by Artificial Intelligence to ensure their protection. The research method used is normative legal research. The results show that the legal regulation related to Artificial Intelligence in Indonesia is still inadequate. Existing regulations, such as the ITE Law and the Electronic System and Transaction Provider Government Regulation (PP PSTE), do not specifically encompass Artificial Intelligence, thereby creating legal uncertainties for the public and industry players. Legal protection for workers who may be replaced by Artificial Intelligence is also insufficient, necessitating more detailed regulations to ensure fairness and adequate protection.
