Abstract

Konsep Cyber Notary hadir sebagai pemanfaatan teknologi dan internet dalam bidang kenotariatan. Sebagai negara hukum, Indonesia mengatur mengenai praktik kenotariatan melalui Undang-Undang Nomor 2 Tahun 2014 Tentang Perubahan Atas Undang-Undang Nomor 30 Tahun 2004 Tentang Jabatan Notaris (“UUJN”), sehingga pelaksanaan jabatan Notaris harus berdasarkan ketentuan dalam UUJN. Salah satu kewajiban Notaris diatur dalam Pasal 16 ayat (1) huruf b UUJN yaitu, untuk membuat Akta dalam bentuk minuta dan menyimpannya sebagai bagian dari Protokol Notaris. Pasal 1 angka 13 dan Penjelasan Pasal 62 UUJN mengatur Protokol Notaris sebagai kumpulan dokumen yang merupakan arsip negara yang harus disimpan dan dipelihara oleh Notaris. UUJN tidak mengatur lebih jelas mengenai mekanisme penyimpanan Protokol Notaris. Jika dikaitkan dengan konsep Cyber Notary, Protokol Notaris dimungkinkan untuk disimpan secara elektronik, salah satunya adalah melalui sistem Enterprise Resource Planning (“ERP”). Permasalahannya adalah bahwa UUJN tidak mengatur mengenai Cyber Notary selain sebagai “kewenangan lain” dan tidak mengatur mengenai penyimpanan Protokol Notaris secara elektronik. Namun sebagai arsip negara, Protokol Notaris juga tunduk pada ketentuan Undang-Undang Nomor 43 Tahun 2009 Tentang Kearsipan (“UU Kearsipan”), yang mengatur mengenai alih media arsip elektronik. Hal ini menunjukkan bahwa terdapat ketidaksinkronan hukum antara UUJN dengan UU Kearsipan. Jika penyimpanan Protokol Notaris dapat dilakukan dengan memanfaatkan sistem ERP sebagai data storage, lalu bagaimana dengan kepastian hukum terhadap keamanan datanya? Mengingat bahwa hubungan dokumen Protokol Notaris dengan Data Pribadi milik klien tidak dapat dipisahkan. Penelitian ini menggunakan jenis penelitian hukum normatif yang merupakan penelitian yang mengkaji hukum tertulis dari berbagai aspek seperti teori dan konsistensi, serta berobjek pada asas hukum dan kebijakan hukum. Jenis pendekatan yang digunakan adalah pendekatan terhadap asas-asas hukum dan sinkronisasi hukum. Penelitian ini dilakukan dengan tujuan untuk mengembangkan aturan hukum yang ada terkait penyimpanan Protokol Notaris dengan memasukkan konsep Cyber Notary dan memecahkan persoalan hukum mengenai kepastian hukum terhadap keamanan data atas penyimpanan Protokol Notaris yang memanfaatkan sistem ERP. / The concept of Cyber Notary exists as a use of technology and the internet in the notarial field. As a legal country, Indonesia regulates notarial practices through Law Number 2 of 2014 concerning Amendments to Law Number 30 of 2004 concerning the Position of Notaries ("UUJN"), so that anything related to the implementation of the position of notary must be based on the provisions of the UUJN. One of the obligations of a notary as regulated in Article 16 paragraph (1) letter b UUJN is to make a deed in minute form and save it as part of the Notarial Protocol. Article 1 number 13 and Elucidation to Article 62 UUJN regulate the Notary Protocol as a collection of documents which constitute state archives which must be kept and maintained by a Notary. UUJN does not regulate more clearly the mechanism for storing Notary Protocol other than the Notary's obligation to store and maintain them, as well as handover the Notary Protocol. When linked to the Cyber Notary concept, it is possible for Notary Protocol to be stored electronically, one way is through an Enterprise Resource Planning ("ERP") system. The problem is that the UUJN does not regulate Cyber Notary other than as "another authority" and does not regulate the electronic storage of Notary Protocol. However, as a state archive, the Notary Protocol is also subject to the provisions of Law Number 43 of 2009 concerning Archives ("Archive Law"), which regulates the transfer of electronic archival media. This shows that there is legal insynchronization between the UUJN and the Archives Law. If notary protocol storage can be done by utilizing an ERP system as a data storage, then what about legal certainty regarding the security of the data? Bearing in mind that the relationship between the Notary Protocol documents and the client's Personal Data cannot be separated. This research uses a type of normative legal research, which is research that examines written law from various aspects such as theory and consistency and has as its object the principles, legal principles, and legal policies. The type of approach used is an approach to legal principles and legal synchronization. This research was conducted with the aim of developing existing legal regulations regarding the storage of Notary Protocol by including the Cyber Notary concept and solving legal issues regarding legal certainty regarding data security for the storage of Notary Protocol that utilize the ERP system.
