Abstract

Dalam transaksi jual beli tanah, seringkali pembeli tidak dapat melakukan pembayaran secara lunas ataupun terdapat syarat yang perlu dipenuhi sebelum dilangsungkan jual beli atas tanah tersebut. Sehingga perjanjian pengikatan jual beli akan dibuat untuk mengakomodir kewajiban dan hak dari masing-masing penjual dan pembeli. Dalam transaksi pengikatan jual beli, sertifikat hak milik atas tanah yang menjadi objek pengikatan jual beli seringkali dititipkan kepada notaris yang membuat akta pengikatan jual beli tersebut. Permasalahan dapat timbul akibat ketidakharmonisan antara penjual dan pembeli karena pembayaran tidak dilunaskan ataupun adanya syarat yang tidak dapat dipenuhi. Permasalahan ini juga memiliki dampak kepada notaris yang menerima penitipan sertifikat hak milik atas tanah dalam objek pengikatan jual beli. Kasus pada Putusan Nomor 33/Pdt.G/2021/PN Gin juncto Nomor 148/PDT/2021/PT DPS juncto Nomor 630 K/Pdt/2023 berawal dari notaris yang menerima penitipan sertifikat hak milik atas tanah dari perjanjian pengikatan jual beli yang tidak dilakukan pembatalan ataupun dilanjutkan oleh para pihak. Hal ini memberikan ketidakpastian bagi notaris yang menerima penitipan sertifikat hak milik atas tanah tersebut. Tujuan dari penelitian ini adalah untuk mengetahui dan memperdalam pengaturan dan pelaksanaan penitipan sertifikat hak milik atas tanah, dan pertanggungjawaban notaris terhadap penitipan sertifikat hak milik atas tanah pada Kasus Putusan Nomor 33/Pdt.G/2021/PN Gin juncto Nomor 148/PDT/2021/PT DPS juncto Nomor 630 K/Pdt/2023. Penelitian ini menggunakan jenis penelitian normatif empiris dengan menggunakan data sekunder yang didukung dengan data primer. Hasil penelitian ini menunjukkan bahwa tidak ada pengaturan secara khusus bagi notaris dalam jabatannya untuk menerima penitipan sertifikat hak milik atas tanah, sehingga pengaturan penitipan sertifikat hak milik atas tanah diatur dalam Kitab Undang-Undang Hukum Perdata. Notaris dalam kasus Putusan Nomor 33/Pdt.G/2021/PN Gin juncto Nomor 148/PDT/2021/PT DPS juncto Nomor 630 K/Pdt/2023 tidak mempunyai tanggung jawab secara pidana, perdata, maupun administratif karena tidak melakukan tindakan yang melebihi dari kewenangan atau dikuasakannya. / In land buying and selling transactions, often the buyer cannot make payment in full or there are conditions that need to be fulfilled before the sale and purchase of the land takes place. So that a binding sale and purchase agreement will be made to accommodate the obligations and rights of each seller and buyer. In a sale and purchase binding transaction, the certificate of ownership of the land that is the object of the sale and purchase agreement is often entrusted to the notary who makes the sale and purchase agreement. Problems can arise due to disharmony between the seller and the buyer because payments are not paid in full or there are conditions that cannot be fulfilled. This problem also has an impact on notaries who receive custody of land ownership certificates in the sale and purchase agreement. The case in Decision Number 33/Pdt.G/2021/PN Gin juncto Number 148/PDT/2021/PT DPS juncto Number 630 K/Pdt/2023 started with a notary who received custody of a land ownership certificate from a sale and purchase agreement that was not can be canceled or continued by the parties. This creates uncertainty for the notary who receives the custody of the certificate of ownership of the land. The aim of this research is to find out and deepen the regulation and implementation of the custody of land ownership certificates, and the responsibility of notaries regarding the custody of land ownership certificates in Decision Case Number 33/Pdt.G/2021/PN Gin juncto Number 148/PDT/2021 /PT DPS juncto Number 630 K/Pdt/2023. This research uses a type of empirical normative research using secondary data supported by primary data. The results of this research show that there are no special arrangements for notaries in their position to receive custody of land ownership certificates, so that the arrangements for the custody of land ownership certificates are regulated in the Civil Code. The Notary in the case of Decision Number 33/Pdt.G/2021/PN Gin juncto Number 148/PDT/2021/PT DPS juncto Number 630 K/Pdt/2023 has no criminal, civil or administrative responsibility because he did not take action that exceeded from authority or power.
