Abstract

Penelitian ini menganalisis pentingnya penerapan sistem notaris elektronik di era digital pasca pandemi di Indonesia. Meskipun menghadapi kemungkinan pandemi virus di masa depan yang serupa dengan COVID-19, Indonesia belum mengadopsi konsep hukum notaris elektronik. Untuk mengatasi masalah ini, penelitian ini menggunakan jenis penelitian hukum normatif-empiris dengan teknik pengumpulan data berupa studi kepustakaan dan wawancara. Pembatasan sosial dan perintah untuk tetap di rumah yang diterapkan sebagai respons terhadap pandemi COVID-19 membuat sulitnya melakukan beberapa kegiatan tatap muka. Oleh karena itu, ada kebutuhan akan metode alternatif yang dapat digunakan oleh notaris untuk melaksanakan tugas dan wewenangnya tanpa memerlukan kehadiran fisik. Dalam konteks ini, ada kebutuhan mendesak untuk memperkenalkan regulasi hukum mengenai notaris elektronik di Indonesia pasca pandemi. Notaris elektronik menawarkan berbagai manfaat, seperti peningkatan kenyamanan, keamanan yang lebih tinggi, efisiensi yang lebih baik, dan pengurangan biaya. Sistem ini akan memungkinkan individu untuk menotarisasi dokumen dari jarak jauh, menghilangkan kebutuhan akan interaksi tatap muka yang menjadi sulit selama pandemi COVID-19. Negara-negara lain, seperti Jerman dan Belanda, telah menyadari pentingnya notaris elektronik dan telah membentuk kerangka hukum untuk memungkinkan notarisasi jarak jauh. Sebagai contoh, Jerman telah mengembangkan sistem notaris elektronik. Selain itu, Persatuan Notaris Internasional (The International Union of Notary atau UINL) memiliki "UINL Guidance on Notarial Authentication With Online Appearance". Kemajuan teknologi, informasi, dan komunikasi dalam masyarakat saat ini mengharuskan notaris untuk meningkatkan kemampuan mereka dalam memberikan layanan hukum terbaik. Solusi terbaik bagi notaris untuk menghadapi tantangan perubahan zaman adalah dengan menerapkan sistem notaris jarak jauh. Namun, hal tersebut tidak luput dari benturan sistem hukum Indonesia. Hal yang perlu diperhatikan adalah alasan Indonesia belum mengimplementasikannya, seperti kesesuaian penerapan remote notary yang berasal dari common law ke dalam sistem hukum Indonesia yaitu civil law dan alasan hukum yang menghambat untuk diterapkannya. / This study analyzes the importance of implementing an electronic notary system in the post-pandemic digital era in Indonesia. Despite facing the possibility of future viral pandemics similar to COVID-19, Indonesia has yet to adopt the concept of electronic notary law. To address this issue, this research employs a normative-empirical legal study method, utilizing literature reviews and limited interviews for data collection. Social restrictions and stay-at-home orders implemented in response to the COVID-19 pandemic made it challenging to conduct certain face-to-face activities. Consequently, there is a need for alternative methods that notaries can use to perform their duties and exercise their authority without requiring physical presence. In this context, there is an urgent need to introduce legal regulations regarding electronic notaries in post-pandemic Indonesia. Electronic notaries offer various benefits, such as increased convenience, enhanced security, higher efficiency, and cost reduction. This system will allow individuals to notarize documents remotely, eliminating the need for face-to-face interactions, which became difficult during the COVID-19 pandemic. Other countries, such as the Germany and the Netherlands, have recognized the importance of electronic notaries and have established legal frameworks to enable remote notarization. For instance, Germany has developed an electronic notary system. Also, The International Union of Notary (UINL) has “UINL Guidance on Notarial Authentication With Online Appearance”. The advancements in technology, information, and communication in today's society require notaries to enhance their capabilities to provide the best legal services. The best solution for notaries to face the challenges of changing times is to implement remote notary systems. However, this is not without obstacles within the Indonesian legal system. Key considerations include the reasons why Indonesia has not yet implemented it, such as the compatibility of applying remote notaries, which originate from the common law system, into Indonesia's civil law system, and the legal reasons that hinder its implementation.
