Abstract

Notaris berpedoman dengan Peraturan Jabatan Notaris, Kode Etik Notaris, dan segala Peraturan perundang-undangan yang terkait dengan tugas dan jabatannya. Unsur Subjektif Notaris terhadap sifat melawan hukum berkaitan dengan niat maupun kesengajaan atas perbuatan melawan hukum yang dilakukan oleh Notaris, terkait Putusan Mahkamah Agung Nomor 645 PK/Pdt/2020 dan Putusan Mahkamah Agung Nomor 1003 K/Pid/2015 didasari dengan unsur-unsur subjektif yang memenuhi elemen-elemen sifat melawan hukum yang mengakibatkan kerugian terhadap pihak yang melakukan perbuatan hukum dalam akta autentik sehingga terjadi adanya akibat hukum terkait atas perbuatan melawan hukum yang dilakukan oleh Notaris tersebut, perbuatan melawan hukum Notaris dapat dilihat dari sisi hukum perdata yang berdasarkan Pasal 1365 KUHPerdata dimana perbuatan yang dilakukan oleh dapat menimbulkan sebab akibat yaitu kerugian yang diderita oleh pihak lain, sedangkan dalam hukum pidana yang didasari oleh Pasal 1 ayat KUHPidana yang mana suatu perbuatan dikatakan pidana apabila perbuatan tersebut telah diatur dalam aturan hukum pidana secara umum maupun secara khusus yang terdapat konsekuensi pidana terhadap perbuatan yang dilanggar./ Notary is guided by the Notary Position Regulation, Notary Code of Ethics, and all laws and regulations related to his duties and positions. The Notary's Subjective Element of the nature against the law is related to the intention and intention of the act against the law carried out by the Notary, related to the Supreme Court Decision Number 645 PK/Pdt/2020 and the Supreme Court Decision Number 1003 K/Pid/2015 based on subjective elements that meet the elements of anti-law nature that result in losses to the party who commits legal actions in authentic deeds so that there are legal consequences related to acts against the law committed by the Notary, acts against the Notary law can be seen from the side of civil law based on Article 1365 of the Civil Code where the actions carried out by can cause causes, namely the consequences of losses suffered by Other parties, while in the criminal law based on Article 1 paragraph of the Criminal Code where an act is said to be criminal if the act has been regulated in the rules of criminal law in general or specifically where there are criminal consequences for the violated act.
