Abstract

Kasus gagal bayar pinjaman online melibatkan aspek hukum dan pelindungan konsumen yang penting untuk diperhatikan guna mencegah praktik penagihan yang melanggar hukum dan melindungi konsumen dari konsekuensi finansial yang merugikan. Penelitian ini dilakukan untuk menguraikan permasalahan mengenai pelindungan konsumen terhadap debitur dalam layanan pinjaman online di Indonesia dan bentuk tanggung jawab sebagai penyelesaian secara non litigasi pada pelindungan konsumen terhadap debitur dalam layanan pinjaman online di Indonesia. Penelitian ini menggunakan penelitian normatif-empiris yang mengintegrasikan unsur normatif, yang mencakup nilai, standar, prinsip, dan undang-undang, dengan unsur empiris yang terkait dengan data dan fakta yang dapat diamati dan diukur. Hasil penelitian ini menunjukkan bahwa pelindungan terhadap debitur dalam layanan pinjaman online di Indonesia masih belum memberikan pelindungan yang baik. Hal ini ditunjukan dengan masih banyaknya pinjaman online yang tidak terdaftar hingga penagihan kepada debitur dengan ancaman dan teror. Terhadap hal tersebut dapat dilakukan penyelesaian sengketa secara non litigasi dengan cara berdamai (musyawarah mufakat) ataupun melalui BPSK. / Cases of debtors whose fail to pay their online loans involve legal and consumer protection aspects, it is important to pay attention to that aspects in order to prevent unlawful collection practices and protect consumers from adverse financial consequences. This research was conducted to analyze problems regarding consumer protection for debtors in online loan services in Indonesia and forms of responsibility as a non-litigation resolution in consumer protection for debtors in online loan services in Indonesia. This research uses normative-empirical research which integrates normative elements, which include values, standards, principles and laws, with empirical elements related to data and facts that can be observed and measured. The results of this research indicate that consumer protection of online loan services in Indonesia still does not provide protection for debtors. This is shown by the large number of illegal online loans that involve debtors being charged with threats and terror. In this case, dispute resolution can be carried out non-litigation by means of reconciliation (consensus) or through BPSK.
