Abstract

Indonesia adalah negara hukum, sehingga dalam setiap administrasi sistem pemerintahan, Indonesia mematuhi hukum yang berlaku. Untuk mengatur fungsi pemerintahan, diperlukan tindakan penegakan hukum. Penegakan hukum bertujuan untuk meningkatkan ketertiban dan kepastian hukum dalam masyarakat. Untuk menegakkan hukum, negara telah mendelegasikan wewenangnya kepada lembaga penegak hukum untuk mewujudkan tujuan hukum, seperti Profesi Notaris. Notaris adalah pejabat umum yang berwenang membuat akta otentik dan kewenangan lain sesuai dengan Undang-Undang. Tujuan dari penelitian ini adalah untuk menganalisis dan mengkaji penegakan hukum dan sanksi terhadap Notaris dalam hal promosi dan publikasi di media sosial. Selain itu, tujuan lainnya adalah untuk menganalisis dan mengkaji batasan-batasan terkait promosi dan publikasi oleh Notaris yang tidak diperbolehkan oleh Undang-Undang Jabatan Notaris dan Kode Etik Notaris. Metode dalam penelitian ini adalah Penelitian Hukum Normatif-Empiris dengan pendekatan studi kasus langsung. Dari hasil penelitian ini, dapat disimpulkan, antara lain, pertama, penegakan hukum dan sanksi terhadap notaris yang melakukan promosi dan publikasi dilakukan oleh Majelis Pengawas Notaris dan Dewan Kehormatan. Sanksi tersebut disebutkan dalam Pasal 6 Kode Etik Notaris dan Pasal 17 ayat (2) Undang-Undang Jabatan Notaris. Kemudian, terdapat batasan yang jelas terkait dengan promosi dan publikasi jabatan notaris. Notaris hanya diperbolehkan memberikan penyuluhan hukum yang informatif dan edukatif, serta memperkenalkan diri tanpa elemen promosi, dengan pengecualian untuk kasus-kasus tertentu seperti memberikan ucapan selamat atau belasungkawa tanpa menyebut jabatan, nama, dan alamat di buku panduan resmi, serta penempatan papan nama dengan ukuran terbatas. / Indonesia is a legal state, so in every administration of the governmental system, Indonesia adheres to the prevailing laws. To regulate the functioning of a government, law enforcement actions are required. Law enforcement is aimed at enhancing order and legal certainty in society. To enforce the law, the State has delegated its authority to law enforcement agencies for the realization of legal objectives, such as the Notary Profession. A Notary is a public official authorized to create authentic deeds and other authorities as stipulated in the Law. The purpose of this research is to analyze and examine law enforcement and sanctions against Notaries in terms of promotion and publication on social media. In addition, another aim is to analyze and examine the limitations on promotion and publication by Notaries that are not allowed by the Notary Position Law and Notary Code of Ethics. The method in this research is Normative-Empirical Legal Research using a live case study approach. From the results of this research, it can be concluded, among other things, first, law enforcement and sanctions against notaries who promote and publish are carried out by the Notary Supervisory Board and legal authorities. The sanctions are mentioned in Article 6 of the Notary Code of Ethics and Article 17 paragraph (2) of the Notary Position Law. Then, there are clear limitations related to the promotion and publication of the notary position. Notaries are only allowed to provide legal counseling that is informative and educational, and to introduce themselves without promotional elements, with exceptions for specific cases such as giving congratulations or condolences without mentioning position, name, and address in official guidebooks, and placing road signs with limited size.
