Abstract

Tujuan dilakukannya penelitian ini adalah untuk membahas adanya indikasi kerjasama yang dilakukan di dalam tender yang melanggar hukum persaingan usaha yang dilakukan oleh PT. Swakarsa Tunggal Mandiri, PT. Sekawan Jaya Bersama, dan PT. Fifo Pusaka Abadi dicurigai terlibat dalam tindak persekongkolan dan telah ditetapkan oleh putusan KPPU dan dilakukan permohonan keberatan pada studi putusan Nomor 692/PDT.SUS-KPPU/2019/PN MDN. Metode penelitian yang digunakan dalam penelitian tugas akhir ini adalah hukum normatif. Penulis akaan memahami dan menganalisis putusan Nomor 692/PDT.SUS-KPPU/2019/PN MDN dan menggunakan bahan sekunder atau bahan kepustakaan untuk lebih memperluas pembahasan dalam penelitian ini. Analisis dalam penelitian ini bersifat kualitatif. Sumber data peneliti didapat dari bahan kepustakaan berupa direktori putusan pengadilan negeri, serta bahan kepustakaan lainnya. PT. Swakarsa Tunggal Mandiri, PT. Sekawan Jaya Bersama, dan PT. Fifo Pusaka Abadi dicurigai terlibat dalam tindak persekongkolan dengan sengaja mengatur serta telah menentukan siapakah yang menjadi pemenang tender bersama dengan peserta lainnya, yang bertentangan dengan persaingan usaha yang sehat. Tuduhan ini harus ditangani secara hati-hati dan obyektif. Sabotase dalam penawaran adalah tindakan kedua pihak dimana merupakan tindakan oleh penyedia barang atau jasa atau biasa disebut peserta tender dan pengguna barang atau jasa yang dimana mengatur pemenang tender barang / jasa. Dalam proyek Unit Barang/Jasa Pelaksanaan Jalan Tol Seksi II di Kabupaten Sumut. Komisi Pengendali Persaingan Niaga (KPPU) mendapat informasi dugaan pelanggaran pengamanan jalan perbatasan proyek Perluasan Provinsi Aceh-Barus-Sibolga Satgas Jalan Nasional Sumut II dengan ditemukannya berbagai kejanggalan dan kesamaan dokumen diantara perusahaan tersebut. Ketiga perusahaan tersebut pun melakukan permohonan keberatan terhadap keputusan dari KPPU mengenai adanya tindakan melanggar hukum persaingan usaha. / The purpose of this research is to discuss indications of cooperation carried out in tenders that violate business competition law carried out by PT. Swakarsa Tunggal Mandiri, PT. Sekawan Jaya Bersama, and PT. Fifo Pusaka Abadi is suspected of being involved in a conspiracy and has been determined by the KPPU decision and an objection request has been made to the study of decision Number 692/PDT.SUS-KPPU/2019/PN MDN. The research method used in this final assignment research is normative law. The author will understand and analyze decision Number 692/PDT.SUS-KPPU/2019/PN MDN and use secondary materials or library materials to further expand the discussion in this research. The analysis in this research is qualitative. The researcher's data source was obtained from library materials in the form of a directory of district court decisions, as well as other library materials. PT. Swakarsa Tunggal Mandiri, PT. Sekawan Jaya Bersama, and PT. Fifo Pusaka Abadi is suspected of being involved in a conspiracy by deliberately organizing and determining who will be the winner of the tender together with other participants, which is contrary to healthy business competition. These allegations must be handled carefully and objectively. Sabotage in bidding is an action by both parties which is an action by providers of goods or services or usually called tender participants and users of goods or services which determines the winner of the tender for goods/services. In the Goods/Services Unit project for Section II Toll Road Implementation in North Sumatra Regency. The Commercial Competition Control Commission (KPPU) received information about alleged violations of border road security for the Aceh-Barus-Sibolga Province Expansion Project of the North Sumatra National Road Task Force II with the discovery of various irregularities and similarities in documents between the companies. The three companies also filed an objection request against the KPPU's decision regarding their actions violating business competition law.
