Abstract

Perjanjian adalah persetujuan (tertulis atau dengan lisan) yang dibuat oleh dua pihak atau lebih, masing-masing bersepakat akan menaati apa yang telah disepakati dalam perjanjian tersebut. Perjanjian merupakan salah satu hal yang sering terjadi di masyarakat, dan juga timbul banyak permasalahan dalam perjanjian. Tujuan dari penelitian ini adalah mengetahui dan menganalisis mengenai akibat hukum terhadap pembatalan suatu perjanjian kerjasama yang dilakukan secara sepihak dan mengetahui serta menganalisis perlindungan hukum bagi pihak yang dirugikan terhadap pembatalan perjanjian secara sepihak pada Putusan Pengadilan Negeri Cirebon Nomor 34/Pdt.G/2013/PN.Cn juncto Putusan Pengadilan Tinggi Bandung Nomor 273/Pdt/2014/PT.BDG juncto Putusan Mahkamah Agung Republik Indonesia No. 28 K/Pdt/2016. Daripada sumber-sumber tersebut. Kesimpulan dari penelitian ini adalah perjanjian yang telah disepakati bersama tetap berlaku bagi kedua belah pihak dan berhak mengajukan gugatan ke Pengadilan dan dan mendapatkan biaya ganti rugi atas apa yang telah dikerjakannya./ An agreement is an arrangement (written or verbally) which made by two or more parties, each of them agreed to comply with what has been agreed in the agreement. Agreement is one of the matters that often happens in community, and also many issues arise in the agreement itself. The purpose of this research is to find out and analyze the legal consequence due to the unilateral cancellation of cooperation agreement and to find out also analyze any legal protection for injured party against the unilateral cancellation of cooperation agreement in Cirebon Disctrict Court Decision Number 34/Pdt.G/2013/PN.Cn juncto Bandung High Court Decision Number 273/Pdt/2014/PT.BDG juncto Supreme Court Decision of the Republic of Indonesia No. 28 K/Pdt/2016. The conclusion of this research is that the agreement that has been mutually agreed remains valid for both parties and has the right to bring a lawsuit to the Court and obtain compensation for what he has done.
