Abstract

The function of a public notary is a position whom existence is desired in order to create legal relations between civil subjects. Notaries as one of the public officials who have an important role that is trusted by the government and the community to assist the government in serving the community in ensuring certainty, order, and legal protection through authentic deeds made by or before them. As functionary who carry out their duties, notaries are required to follow the rules of the Function of Notary. The problem in this study is related to legal certainty in the consideration of judges in Verdict No. 1857 / Pid.B / 2017 / PN.Tng as well as clarity on the status of the notary profession related to Article 13 of the Notary Position Law. The method used in this study is the type of empirical juridical research and approach to legislation, concepts and cases. Data collection was obtained from primary data and secondary data, and then analyzed by deductive logic analysis methods. The results of this study ultimately provide an answer that the judge's consideration in giving probation to Verdict No. 1857 / Pid.B / 2017 / PN.Tng considered not to provide legal certainty where the notary who intentionally falsified the deed had violated the provisions of Article 264 of the Criminal Code concerning the falsification of authentic deeds. In addition, Article 13 of the Notary Position Law in its application does not yet have the clarity to dismiss the notary directly from the Minister of Law and Human Rights. Suggestions in this study are for judges who handle Verdict No. 1857 / Pid.B / 2017 / PN.Tng it is recommended to follow the demands of the Public Prosecutor which is considered to be close to legal certainty. Direct clarity is needed in Article 13 of the Notary Position Act to dismiss a notary who has clearly violated the article in order to create legal certainty in its application. / Jabatan notaris merupakan jabatan yang keberadaannya dikehendaki guna mewujudkan hubungan hukum diantara subyek-subyek hukum yang bersifat perdata. Notaris sebagai salah satu pejabat umum mempunyai peranan penting yang dipercaya oleh pemerintah dan masyarakat untuk membantu pemerintah dalam melayani masyarakat dalam menjamin kepastian, ketertiban, dan perlindungan hukum melalui akta autentik yang dibuat oleh atau di hadapannya. Sebagai pejabat yang melaksanakan tugasnya, notaris diwajibkan untuk mengikuti peraturan Jabatan Notaris. Permasalahan dalam penelitian ini adalah terkait dengan kepastian hukum pada pertimbangan hakim dalam Putusan No. 1857/Pid.B/2017/PN.Tng serta kejelasan status profesi notaris tersebut terkait Pasal 13 Undang-Undang Jabatan Notaris. Metode yang digunakan dalam penelitian ini adalah dengan jenis penelitian yuridis empiris dan pendekatan perundang-undangan, konsep serta kasus. Pengumpulan data diperoleh dari data primer dan data sekunder, kemudian dianalisis dengan metode analisis logika deduktif. Hasil penelitian ini pada akhirnya memberikan jawaban bahwa pertimbangan hakim dalam memberi hukuman percobaan pada Putusan No. 1857/Pid.B/2017/PN.Tng dinilai tidak memberikan kepastian hukum dimana notaris yang sengaja melakukan pemalsuan akta telah melanggar ketentuan Pasal 264 KUHP tentang pemalsuan akta autentik. Selain itu Pasal 13 Undang-Undang Jabatan Notaris dalam penerapannya belum memiliki kejelasan untuk memberhentikan notaris secara tidak hormat secara langsung oleh Menteri Hukum dan Hak Asasi Manusia. Saran dalam penelitian ini adalah agar hakim yang menangani Putusan No. 1857/Pid.B/2017/PN.Tng disarankan untuk mengikuti tuntutan Jaksa Penuntut Umum yang mana dinilai mendekati kepastian hukum. Diperlukan kejelasan secara langsung dalam Pasal 13 Undang-Undang Jabatan Notaris untuk memberhentikan notaris yang sudah jelas melanggar pasal tersebut agar tercipta kepastian hukum dalam penerapannya.
