Abstract

Dalam memperoleh tambahan dana untuk modal usaha , dapat dilakukan dengan meminjam uang pada Bank dengan memberikan jaminan berupa sertipikat hak atas tanah , dalam proses peminjaman tersebut dilakukan dengan penandatangan perjanjian kredit diikuti pemberian jaminan Hak Tanggungan . Pemenuhan tata cara pembebanan Hak Tanggungan meliputi dua tahap, yaitu : Tahap pemberian Hak Tanggungan dengan dibuatkannya Akta Pemberian Hak Tanggungan dihadapan Pejabat Pembuat Akta Tanah (PPAT), dan Tahap Pendaftaran Hak Tanggungan pada Kantor Pertanahan. Kementerian Agraria dan Tata Ruang / Kepala Badan Pertanahan Nasional saat ini telah menerbitkan peraturan baru mengenai pelayanan pendaftaran Hak Tanggungan yaitu Peraturan Menteri Agraria dan Tata Ruang/ Kepala Badan Pertanahan Nasional Republik Indonesia Nomor 9 Tahun 2019 . Dalam penulisan tesis ini, jenis metode penelitian yang Penulis gunakan adalah metode penelitian yuridis normatif. Metode pengumpulan data yang penulis digunakan adalah menggunakan metode pendekatan undang – undang, konseptual dan historis. Pendaftaran Hak Tanggungan secara elektronik memiliki mekanisme yang berbeda dengan pendaftaran secara manual seperti yang selama ini dijalankan , dan juga terdapat kendala – kendala dalam proses pendaftaran secara elektronik antara lain Sertipikat hak atas tanah atau hak milik atas satuan rumah susun harus atas nama debitur. / In obtaining additional funds for business capital, it can be done by borrowing money from the Bank by providing collateral in the form of a certificate of land rights, in the process of lending done by signing a credit agreement followed by granting Mortgage Rights. Fulfillment procedure for encumbering Mortgage includes two stages, namely: Stage of granting Mortgage Rights by making Deed of Granting Mortgage Right in front of the Land Drafting Officer (PPAT), and Registration Stage of Mortgage Rights at the Land Office. The Ministry of Agrarian Affairs and Spatial Planning / Head of the National Land Agency has now issued a new regulation regarding the service registration of Mortgage Rights, namely Regulation of the Minister of Agrarian Affairs and Spatial Planning / Head of the National Land Agency of the Republic of Indonesia Number 9 of 2019. In writing this thesis, the type of research method that the author uses is a normative juridical research method. The data collection method used by the author is using the method of approach to the law, conceptual and historical. The electronic registration of mortgage rights has a different mechanism than the manual registration that has been carried out so far, and there are also constraints in the electronic registration process, including certificates of land rights or ownership rights over flats, which must be on behalf of the debtor.
