Abstract

Penulisan ini bertujuan untuk mengetahui kekuatan hukum Sertipikat Hak Guna Bangunan Nomor 22 kepemilikan PT SURYACIPTA SWADAYA terhadap tuntutan/gugatan dengan hak atas tanah asal Leter C yang dijadikan sebagai alat bukti kepemilikan oleh Ahli Waris ENJU alias Pak OYIB yang terletak di Desa Mulyasari, Kecamatan Ciampel, Kabupaten Karawang. Bagaimana pertimbangan hukum pada putusan Mahkamah Agung Perkara Nomor 3010K/Pdt./2015, ditinjau dari Undang-undang Nomor 5 Tahun 1960 tentang Peraturan Dasar Pokok Agraria dan Peraturan Pemerintah Nomor 24 Tahun 1997 yang hingga pada akhirnya menciptakan kepastian hukum serta solusi dalam penyelesaian tengketa dengan bukti kepemilikan tersebut. Hasil dari penulisan ini bahwa Sertipikat hak atas tanah berfungsi sebagai alat pembuktian yang memberikan jaminan kepastian hukum mengenai orang yang menjadi pemegang hak atas tanah, kepastian hukum mengenai lokasi dari tanah miliknya sementara Letter C dan Surat Pajak Bumi dan Bangunan tidak dapat diterima sebagai tanda bukti kepemilikan tanah adalah sebagaimana tercantum dalam DPPT PBB yang menyatakan bahwa “Tanda pembayaran/atau pelunasan pajak bukan merupakan bukti kepemilikan hak”. Kurangnya pengetahuan masyarakat tentang hak atas tanah dan kurangnya penyuluhan yang diberikan tentang arti kepemilikan sertipikat hak atas tanah, selain itu juga memberikan pemahaman-pemahan kepada masyarakat terkait sengketa tanah yang diakibatkan lemahnya bukti kepemilikan hak atas tanah. / This thesis hopes to find out the legal strength of the Certificate of Right to Use (HGB) Number 22 ownership of PT SURYACIPTA SWADAYA against claims / lawsuits with land rights from Leter C which are used as evidence of ownership by ENJU heirs alias Mr. OYIB located in Mulyasari Village, Ciampel District, Karawang Regency. It seeks to see how the legal consideration in the decision of the Supreme Court Case Number 3010K / Pdt. / 2015, in view of Law Number 5 of 1960 concerning Basic Agrarian Regulations and Government Regulation Number 24 of 1997 ultimately creates legal certainty and solutions in resolving disputes with proof of ownership. This thesis conc that the certificate of land rights serves as a means of proof that guarantees legal certainty regarding the person who holds the rights to land, certainty about the location of land which states that Letter C and Land and Building Tax Letter can not be accepted as proof of ownership of land as mentioned in the PBB DPPT which states "A sign of payment/or tax settlement is not proof of ownership rights". General lack of knowledge about land rights and counseling given about the meaning of ownership certificates of land rights, in addition to providing understandings to the community in relation with land disputes resulting from weak evidence of ownership of land rights.
