Abstract

Notary is a general official who has the authority to make authentic deeds. The existence of notary public, has a very important role in ensuring the legality of the deeds. The notary law governs that the notary who has exercised his function as an authentic deed maker, for 2 (two) years, then the Notary has the right to leave of absence. Leave can be submitted in writing by notary Maximal 5 (five) years and the amount of leave allowance during the term of office is as many as 12 (twelve) years. Before carrying out the cuter, a notary must submit the application to MPD, MPW or MPP (this is adjusted to the time of the leave of absence). When conducting a leave, notary is not allowed to make any deeds, because in the condition of the leave, all authority and obligations of notary Public, has been handed to the notary public. This is evidenced by the creation of the report of the submission and acceptance of the notary protocol of notary public that will leave to the subtitution of notary public. If the notary at the time of conducting the leave continues to execute his position in making the deed, then there is a legal effect on his actions that the notary may be penalized in accordance with article 85 UUJN ie with termination While. Then, to the power of proving the deed has also been degraded into a privately made deed as the provisions of article 1869 Civil Code. / Notaris adalah pejabat umum yang memiliki kewenangan untuk membuat akta autentik. Keberadaan Notaris dalam masyarakat, memiliki peran yang sangat penting dalam hal menjamin legalitas dari akta-akta yang dibuatnya. Kemudian, Undang-Undang Jabatan Notaris mengatur bahwa Notaris yang telah menjalankan fungsinya sebagai pembuat akta autentik, selama 2 (dua) tahun, memiliki hak untuk cuti. Cuti dapat diajukan secara tertulis oleh Notaris maximal 5 (tahun) dan jumlah jatah cuti selama menjalankan jabatannya adalah sebanyak-banyaknya 12 (dua belas tahun). Sebelum melaksanakan cutinya, seorang Notaris harus menyampaikan permohonan cutinya kepada MPD, MPW atau MPP (hal ini disesuaikan dengan masa cuti yang dimohonkan). Saat melaksanakan cuti, Notaris tidak diperbolehkan untuk membuat akta, karena dalam keadaan cuti tersebut, segala kewenangan dan kewajiban Notaris yang sedang cuti, telah diserahkan kepada Notaris penggantinya. Hal ini dibuktikan dengan dibuatnya berita acara penyerahan dan penerimaan Protokol Notaris dari Notaris yang akan cuti kepada Notaris Pengganti. Apabila Notaris pada saat melaksanakan cuti tersebut tetap menjalankan jabatannya dalam membuat akta, maka terdapat akibat hukum terhadap tindakannya tersebut yaitu Notaris dapat dikenakan sanksi sesuai dengan Pasal 85 UUJN yaitu dengan pemberhentian sementara. Kemudian terhadap kekuatan pembuktian akta yang dibuatnya pun telah terdegradasi menjadi akta di bawah tangan sebagaimana ketentuan Pasal 1869 KUHPerdata.
