Abstract

Pengaturan mengenai PPPSRS khususnya mengenai pembentukan PPPSRS dalam Undang-Undang Nomor 20 Tahun 2011 Tentang Rumah Susun (“UU Rusun”) dan peraturan pelaksanaanya yaitu Peraturan Pemerintah Nomor 4 Tahun 1988 Tentang Rumah Susun (“PP Rusun”) masih dianggap belum cukup lengkap mengatur. Sehingga pada tahun 2018 terbitlah Peraturan Menteri Pekerjaan Umum dan Perumahan Rakyat Nomor 23/PRT/M/2018 Tentang Perhimpunan Pemilik Dan Penghuni Satuan Rumah Susun (“Permen PUPR”) dan di tingkat Provinsi DKI Jakarta terbit Peraturan Gubernur DKI Jakarta Nomor 132 Tahun 2018 Tentang Pembinaan Pengelolaan Rumah Susun Milik (Pergub DKI). Namun dalam Pergub DKI tersebut terdapat beberapa ketentuan mengenai pembentukan PPPSRS yang bertentangan dengan UU Rusun dan peraturan pelaksanaannya sehingga diperlukan penelitian secara yuridis normatif sehingga dapat diketahui ketentuan manakah yang tepat dalam pengaturan pembentukan PPPSRS. Dalam penelitian ini, pengumpulan data dilakukan dengan menggunakan pendekatan perundang-undangan. Dari hasil penelitian dapat disimpulkan bahwa ketentuan pembuatan akta pendirian secara notaril dalam Pergub DKI bertentangan dengan peraturan perundang-undangan yang secara hierarki lebih tinggi, yang mengatur bahwa pembuatan akta pendirian PPPSRS cukup dengan akta di bawah tangan. Selain mengenai pembuatan akta pendirian PPPSRS, di dalam Pergub DKI juga terdapat ketentuan yang bertentangan dengan UU Rusun yaitu hak suara pemilihan dalam PPPSRS untuk memilih pengurus dan pengawas PPPSRS. UU Rusun hanya mengatur tiga hak suara dalam PPPSRS, yaitu hak suara kepemilikan, hak suara pengelolaan, dan hak suara penghunian, sehingga ketentuan mengenai hak suara pemilihan tersebut merupakan norma baru yang bertentangan dengan UU Rusun dan harus dibatalkan / Arrangements regarding PPPSRS especially regarding the formation of PPPSRS in Law Number 20 of 2011 concerning Flats ("Flats Law") and implementing regulations namely Government Regulation Number 4 of 1988 concerning Flats ("GR Flats") are still considered to be incomplete enough to regulate. So that in 2018 was issued the Minister of Public Works and Public Housing Regulation No. 23 / PRT / M / 2018 concerning the Association of Owners and Residents of Flats ("PUPR Minister Regulation") and at the Provincial level of DKI Jakarta was issued the Governor of DKI Jakarta Regulation No. 132 of 2018 concerning The Fostering Of The Management of Own Flats (Pergub DKI). However, in the Jakarta Governor Regulation there are several provisions regarding the formation of PPPSRS that are contrary to the Law on Flats and implementing regulations so that a normative juridical study is needed so that it can be known which provisions are appropriate in the regulation of the formation of PPPSRS. In this study, data collection was carried out using a statutory approach. From the results of the study it can be concluded that the provisions for making notarial deeds of association in the Pergub DKI are contrary to the legislation which is hierarchically higher, which stipulates that the making of the association deed of PPPSRS is sufficient with a deed under the hand. In addition to making the deed for the association of PPPSRS, in the Pergub DKI there are also provisions that contradict the Flats Law, namely election voting right in the PPPSRS to elect the management and supervisors of PPPSRS. The Flats Law only regulates three voting rights in the PPPSRS, namely ownership voting right, management voting right, and residential voting right, so that the provisions regarding election voting right is a new norm that conflicts with the Flats Law and must be canceled.
