Abstract

Dunia perbankan dalam pemberian kredit pada umumnya kreditur (Bank) menginginkan bentuk agunan berupa tanah. Tanah merupakan obyek yang dapat diikat dengan Hak Tanggungan, sehingga nantinya Bank akan menjadi Kreditur Preferen. Tanah yang dijaminkan harus dilihat dasar dokumen legalitasnya karena akan menentukan nantinya yang akan ikut menandatangani APHT pihak mana saja. APHT menjadi dasar bagi Bank dimana Bank merupakan Kreditur Preferen untuk mempunyai hak eksekusi yang kuat terhadap tanah tersebut. Apabila pemilik agunan terikat dengan suatu pernikahan maka pasangan dari pemilik agunan wajib untuk ikut menandatangani APHT tersebut karena ketika terjadi suatu pernikahan maka harta yang diperoleh selama pernikahan merupakan harta bersama. Tidak diikutsertakannya pasangan dalam menandatangani APHT ini apabila pasangan suami isteri memiliki perjanjian perkawinan.Perjanjian perkawinan yang sah adalah perjanjian perkawinan yang sudah didaftarkan di Kantor Pencatat Perkawinan sesuai amanat dalam Pasal 29 ayat (1) UU Perkawinan. Metode penelitian yang digunakan oleh peneliti adalah metode penelitian hukum normatif. Setelah melakukan penelitian, peneliti menarik kesimpulan bahwa perjanjian perkawinan yang tidak didaftarkan tetap sah bagi para pihak yang membuatnya namun tidak mengikat untuk pihak ketiga dan untuk hak eksekusi dari kreditur terhadap objek hak tanggungan menjadi terganggu karena dikhawatirkan akan muncul sengketa terhadap tanah tersebut. Saran dari peneliti untuk notaris agar lebih mensosialisasikan kembali mengenai kewajiban pendaftaran perjanjian perkawinan yang telah dibuat dan untuk bank serta debitur agar melakukan permohonan ke pengadilan negeri untuk dikeluarkan nya surat penetapan pengadilan sehingga perjanjian perkawinan dapat secara sah didaftarkan / In the world of banking, in giving credit in general creditors (banks) want a form of collateral in the form of land. Land is an object that can be bound with Mortgage Rights, so that the Bank will later become a Preferred Credit Creditor. The guaranteed land must be seen based on its legality documents because it will determine later which will participate in signing the Deed of Granting Mortgage of any party. The ownership of the pledged land must be completed with the documents of the collateral owner himself. If the collateral owner is bound to a marriage, the spouse of the collateral owner is obliged to sign the Deed of Granting Mortgage because when a marriage occurs, the assets obtained during the marriage are joint property. The spouse is not included in signing this Deed of Granting Mortgage if the couple has a marriage agreement. A legal marriage agreement is a marriage agreement that has been registered at the Marriage Registry Office in accordance with the mandate in Article 29 paragraph (1) of the Marriage Law. The research method used by researchers is the normative legal research method. After conducting the research, the researcher draws the conclusion that marriage agreements that are not registered remain valid for the parties who made them but are not binding for third parties and for the execution rights of creditors against the object of mortgage rights are disturbed because it is feared that a dispute will arise over the land. Suggestions from researchers for notaries to further re-socialize regarding the registration obligations of marriage agreements that have been made and for banks and debitor to submit an application to the district court for the issuance of a court decision so that the marriage agreement can be legally registered
